Why This Is Important

I have read too many chat forums where one spouse leaves the relationship and takes the children and nothing can be done about it. Its completely legal at this point. A scorned spouse will take your children and go in hiding and there is nothing that can be done about it. I called the police myself and was told my children were in good hands. It's been 42 days since I have seen my children. I have never done any harm to my wife or children and there has never been any form of violence filed against me, And I am not a violent person. I have only been able to facetime with my daughter and she will look around for me while i'm talking to her. She doesnt understand. Myself and many others are going through the same thing. Alabama parents rights groups allege state profits off of broken families

"Alabama parents rights groups are crying foul over federal incentive payments to the States under a Social Security program that pays two dollars for every dollar collected by the State for State-imposed child support orders. [42 U.S.C. §658a] The groups allege these laws promote aggressive practices which result in constitutional rights violations and unnecessary government intrusion into the parent-child relationship.

As early as 1998, the U.S. House Ways and Means Committee admitted, 'Most States make a profit on their child support program.' The committee also noted, 'States are free to spend this profit in any manner the State sees fits.

In 2002, the same House committee reported that, 'The overall financial impact of the child support enforcement program on taxpayers is negative.' [Committee Report, page 8-69] The American taxpayers lost $2.7 billion on the program in 2002 alone."

The Fed pays/matches 2 dollars to every 1 collected in child support orders? Sounds to me like the States have a pretty good ponzi scheme going on, making billions off the US taxpayers, putting "the States" best interests and profiteering ahead of the best interest of children and families. It's "all about the money" as usual, and ironically it is "we the people", the taxpayers, that are supporting this ponzi scheme and madness, wake up people!

...and people wonder why the country is 15 trillion in debt and why families are being torn apart? This is only one of the many reasons. It surely seems that if the many different arms of government are not full of corruption, fraud and or extortion, that they are just simply not working correctly and doing more harm than good.

No matter how one looks at it, divorce is a costly matter. In addition to the emotional toll it takes on family members, there is also a financial consideration that cannot be overlooked. In fact, divorce has become a $28-billion-a-year business, with the average cost coming out to approximately $20,000 per couple. The cost of divorce for both spouses involved, as well as to taxpayers, is more extensive than people realize.

Of course, not every divorce costs $20,000. You don't need an online PhD to realize that the greater the parties' financial assets and the more emotional baggage is involved, the higher the costs tend to be. If a divorce is amicable and straightforward, the costs can be substantially less than when the divorce is being contested or where assets are being hidden.

Divorce attorneys typically charge by the hour, with fees ranging from $100 to $500 an hour. Some high-priced attorneys charge upwards of $10,000 for a retainer. In general, those attorneys deal especially with high-profile divorce cases, such as sports figures and celebrities.

Divorce fees aren't restricted to just paying the attorneys involved. In addition, court costs usually include filing fees, process-serving, and serving subpoenas. The total divorce cost rises if the case goes to trial or requires any additional costs involving temporary court orders.

Another factor that shouldn't be ignored is the cost of divorce to taxpayers. According to a study conducted by economist Ben Scalfidi, the cost of divorce and childbirth out of wedlock to United States taxpayers comes out to over $112 billion annually. This cost reflects federal, state, and local expenditures on government welfare and related support programs, as well as lost taxes.

When individuals find themselves having to go to family court for divorce proceedings there are additional, less tangible costs involved. For example, employees tend to become less productive when going through family crises such as divorce. This toll is taken both in terms of worker concentration and also the work hours lost when employees are in family court to resolve legal issues.

Lastly, when children are involved with divorce the psychological repercussions can be devastating. In order to keep children from feeling responsible for the breakdown of their parents' marriages, counseling is sometimes necessary. The cost of therapy can easily be greater than the fees involved in the divorce itself.

In light of the financial factors involved, some couples seek therapy and counseling rather than using the “nuclear option” of divorce. Naturally, if the marriage is beyond repair no amount of therapy will keep it intact. However, if a marriage can be salvaged, the emotional and financial benefits cannot be overemphasized.

Should It Be Illegal To Make Children Choose Who They Want To Live With During Divorce?

Divorce laws are different for each state, including laws about children testifying, children choosing which parent with whom they would like to live, and the various decisions made on behalf of the children. Parents agree on how to raise their children, but during and after a divorce, they may not agree on what they should do with their children. This can cause the children to become more involved in the conflict than necessary. For example, one parent may continue to rebut their decision throughout a divorce or sometimes a parent can try to keep the children just as a revenge tool. Sadly, these issues can put the child right in the middle.

Divorce is already a stressful process for the children without putting them in the middle of the dispute. When children are forced to make decisions such as which parent they would like to live, it could cause behavioral problems, poor grades in school and other emotional issues. It doesn’t matter if you have a criminal justice degree or a psychology degree. Everyone needs to understand the emotional complications and issues that can arise in a divorce; especially when children are involved.

In some cases, the children may not wish to choose from one parent or the other. If the children are afraid of one parent, because of an abusive history for example, this could also cause behavioral problems and poor performance in school if the child is forced to live with that abusive parent.

There are two schools of thought on whether it should be illegal to make children choose who they want to live with during a divorce — and after a divorce. If it is illegal to make a child choose, then the ability for the child to choose voluntarily may be compromised. If the voluntary choice is compromised, then a child might be forced to live with a potentially abusive parent.

Whether the abuse is emotional or physical, it affects the child in such a way to cause low self-esteem, poor performance in school and many other behavioral problems. When a child acts out, he or she may even go so far as to physically abuse parents and pets, because he or she doesn’t know how to control his or her emotions.

If states allow children to choose which parent to live with, the child could be happy in circumstances where there is abuse from one parent. The problem with allowing a child to choose arises when the child loves both parents and both parents are equally involved in the child’s life and are equally loving and caring toward the child. This decision is a hard decision on a child or even a young adult. For example, the child may feel that if he or she chooses mom over dad, dad will think the child doesn’t love him or her. This causes a whole range of psychological issues with the child.

While most courts demand that the parents do not involve the children in the process of the divorce, even to the point of filing a standing order upon the filing of the case, there are going to be situations where the child may be forced to make a decision. If mom gets custody in a custody battle, but the child doesn’t want to live with her because she is abusive or has a substance abuse problem, the only person happy in this situation is mom. Generally, the courts will order home studies and psychological evaluations if substance abuse or physical and/or emotional abuse are alleged, and hopefully, the outcome is such that the child is put with the non-abusive parent.

In conclusion, “illegal” is a strong term, and it takes the possibility of making a choice away from a child. While most courts, depending on the state, will not even let a child make a choice until he or she is 12-16 years of age, the option should still be there. A child should feel that he or she is allowed to voice his or her opinion if he or she thinks his or her personal well-being is in danger. Even a young child can tell authorities that he or she is afraid of one parent and why. A child can always ask to testify on behalf of himself or herself if he or she understands the ramifications and the needs of such testimony. In extreme circumstances, a parent, guardian, relative or friend may step in and ask the court to appoint a guardian ad litem, which is a person to represent the child in divorce proceedings. Depending on your state, a guardian ad litem could be an attorney, a social worker or volunteers in a program.

Allowing the child to choose depends on the child’s maturity level, age, and desires. Making the ability to choose illegal takes this away from a child that may need the ability to voice his or her concerns and make his or her own choice, or have someone to help him or her make the choice.

But in what might seem like an un-American plot twist from a Charles Dickens’ novel, advocates for the poor say, some parents are wrongly being locked away without any regard for their ability to pay — sometimes without the benefit of legal representation.

Randy Miller, a 39-year-old Iraqi war vet, found himself in that situation in November, when a judge in Floyd County, Ga., sent him to jail for violating a court order to pay child support.
He said he was stunned when the judge rebuffed his argument that he had made regular payments for more than a decade before losing his job in July 2009 and had recently resumed working.
‘Debtors’ prisons’?
“Languishing in jail for weeks, months, and sometimes over a year, these parents share one trait … besides their poverty: They went to jail without ever talking to an attorney,” according to the lawsuit filed by the nonprofit Southern Center of Human Rights in Atlanta.

Fathers or Piggy Banks?

I can understand why Thomas Ball doused himself with gasoline and set himself
on fire. There was no escape. Nobody cared. This was the ultimate call for
attention, a scream into the universe for all the world to hear about the plight
of fathers. A father of three, Ball correctly noted that “we are no longer
fathers, just piggy banks.”

Ball was faced yet again with jail for a child support amount he could not
pay. He wrote in his last statement, “I could have made a phone call or two and
borrowed the money. But I am done being bullied for being a man.”

When one engages in criminal enterprises, one expects jail to possibly be a
part of their life. But nobody expects that a hard working stiff or a man who
has served 21 years in the armed forces would be treated like a criminal and
jailed for being poor and a father.

Find a poor mother and she is the elevated “single mother,” and society
scrambles to give her Section 8 housing, free attorneys, and welfare benefits.
Non-profits for her benefit abound.

Find a poor father and he is a “deadbeat dad.” The Supreme Court said in a
recent case, “Seventy percent of child support arrears nationwide are owed by
parents with either no reported income or income of $10,000 per year or
less.”

CONSTITUTION TRUMPS STATE ON CUSTODY ISSUES

"In a perfect world, having both parents there to raise the child is the right way," he said, "but we’re not living in a perfect world. And during a divorce, people are not at their best."

Mr. White misses the point in that the key factor is the current system pits each fit parent against one another and that causes "parents not to be at their best" and the child loses.

The Children's Family Act removes the need for the fighting process and places child rearing decisions on the fit parents, not the state of Alabama.

The following is where current Alabama law is failing children and each fit parent. Just because parents divorce does not make them unfit.

Over the 19 years of the Child's minority, an 80/20 "[Alabama] standard visitation" works out to only 4 years out of 19 with one parent. Is such court-ordered limited parenting time with only one of the Child’s two fit parents in the best interest of any Child?

The Supreme Court of the United States in Troxel v. Granville, 530 U.S. 57 (2000) said the following,

"The Due Process [fundamental fairness] Clause [of the 14th Amendment] does not permit a State [judge] to infringe on the fundamental right of [Fit] Parents to make Child rearing decisions simply because a judge believes a ‘better’ decision could be made."

This due process violation happens daily in Alabama courtrooms. Many times the judge in a contested Child custody determination will not state any reason whatsoever to support the decision. In the absence of findings of fact one or both parents are unfit (which then authorizes intrusion into the parent-child relationship by the court) a Trial Court’s lopsided Parenting time order is unconstitutionally overbroad.

Before the State may constitutionally implicate the fundamental liberty interest of a fit parent, there must be clear and convincing evidence of substantial harm by the Parent to the Child. Santosky v. Kramer, 455 U.S. 745 (1982). Otherwise, the State has no compelling interest which justifies the State [judges] dictating to the fit Parent what is in the best interest of the Child.

Therefore, until a Parent has been proven to be unfit by clear and convincing evidence, no factual condition precedent triggers the parens patriae authority of the State of Alabama to act in place of the fit Parent and decide what is in the best interest of the minor Child. In the typical custody case in which neither fit Parent has caused substantial harm to the Child, Constitutional principles of equal protection and due process require the State’s Child Parenting orders to treat each of the fit Parents as peers, i.e. the equals they are in both fact and law. Due process and equal protection of the laws require that equal citizens at the bar of justice be treated with equal dignity and respect at the bar of justice. In order to pass Constitutional muster, the State of Alabama’s Child Custody orders must scrupulously avoid discriminatory time split favoring either fit Parent - until one party has proven the requisite facts of parental unfitness, which then allows the State to constitutionally treat the Parents differently. This is not currently happening in Alabama family law and why The Alabama Children’s Family Act should become Alabama law.

Of course, the Alabama Court may enter any Parenting time Order which implements any Parenting plan the fit Parents may voluntarily agree. However, if the fit Parents do not agree on a Parenting plan, the Alabama Court’s only constitutionally compliant recourse is to Order equal Child custody between the two fit Parents. In so doing, the Alabama Court protects the constitutional right of the Child to freedom of association with each Parent, treats each Parent with the requisite respect and dignity due to a fit Parent, and equally protects the right the Child to a meaningful relationship with each fit Parent. To do otherwise not only violates the fundamental liberty interest of each fit Parent to a relationship with the minor Child free of unwarranted interference by the State of Alabama, it also violates the liberty interest of the minor Child to be with each fit Parent free of unwarranted interference by the State of Alabama.

Parenting time held to be equal can be any Parenting time arrangement, daily or weekly, when the Parent’s are located in close proximity to one another. Or in two to three year allotments when Parents live long distances apart. Children with Parents in the U.S. military are required to move to different duty stations every three to five years. If such move does not create instability for Children of military Parents, same is true for Children of divorced or unwed fit Parents. Stability for a child - absent a judicial determination of Parental unfitness - is a decision for fit Parents, not the State of Alabama.

BEST INTEREST OF THE CHILD RESIDES FIRST IN THE FIT PARENT, NOT IN THE STATE

In Parham v. J.R., 442 U.S. 584 (1979), the Supreme Court of the United States declared:

"[T]he best interest of the Child' resides in the fit Parent - not in the state: "Our constitutional system long ago rejected any notion that a Child is a "the mere creature of the State" and, on the contrary, asserted that Parents generally "have the right, coupled with the high duty, to recognize and prepare [their Children] for additional obligations."

"The law's concept of the family rests on a presumption that Parents possess what a Child lacks in maturity, experience, and capacity for judgment required for making life's difficult decisions. More important, historically it has recognized that natural bonds of affection lead Parents to act in the best interests of their Children. 442 U.S., at page 602."

Accordingly, so long as a Parent adequately cares for his or her Children (i.e., is fit), there will normally be no reason for the State to inject itself into the private realm of the family to further question the ability of that Parent to make the best decisions concerning the rearing of that Parent's Children." See, e.g., Flores, 507 U.S., at page 304."

STATE LAW MUST CONFORM TO THE U.S. CONSTITUTION

The Supreme Court of the United States in Cooper v. Aaron, 358 U.S. 1 (1958), at page 18, quoting Ableman v. Booth, 62 U.S. 506 (1859), said the following:

"[T]he interpretation of the Fourteenth Amendment enunciated by this [U.S. Supreme] Court ... is the supreme law of the land, and [the Constitution] makes it of binding effect on the States "any Thing in the Constitution or Laws of any State to the Contrary notwithstanding." At page 19, "Every state legislator and executive and judicial officer is solemnly committed by oath taken pursuant to [the Constitution] "to support this Constitution." Chief Justice Taney, speaking for a unanimous [U.S. Supreme] Court, said that this requirement reflected the framers' "anxiety to preserve it [the Constitution] in full force, in all its powers, and to guard against resistance to or evasion of its authority, on the part of a State …"

THE STATE CANNOT PRESUME UNFITNESS

[The U.S. Supreme Court] "held that a state cannot presume a Parent is unfit or that a Parent's exercise of his rights is harmful to his Child." See Santosky v. Kramer, 455 U.S. 745 (1982) (cannot presume a Parent and Child's rights are divergent and that the Parent's exercise of his rights is thus harmful to the Child); see also Stanley v. Illinois, 405 U.S. 645 (1972) (cannot presume an unwed [Parent] is unfit to have custody of [his/her] Children).

"In Stanley v. Illinois, 405 U.S. 645 (1972), the [U. S. Supreme] Court held that the State of Illinois was barred, as a matter of both due process and equal protection, from taking custody of the Children of an unwed father, absent a hearing and a particularized finding that the father was an unfit Parent." Quilloin v. Walcott, 434 U.S. 246, 247-48 (1978).

The State has no interest in interfering with the Parental rights of fit Parents because such Parents are presumed to act in their Child's best interests. Parham v. JR, 442 U.S., at page 602 (The "natural bonds of affection lead Parents to act in the best interests of their Children."); see also Troxel, 530 U.S. at page 69, (applying the "presumption that a fit Parent will act in the best interest of his or her Child").

An Interesting "Parental Alienation" Blog

Cathy Meyer posted an interesting blog in the Huffington Post on January 25, 2011 titled:

I encourage all readers to go there and read this blog, and also to read the comments in the comments section beneath the article, it is quite interesting.

Over the last few months Father's Rights activists have been attempting to have Parental Alienation Disorder added to the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders (DSM V), the American Psychiatric Association's "bible" of diagnoses.

When learning of this effort the National Organization for Women (NOW) became concerned and sent out an Action Alert to counter the campaign. According to NOW's Tracy Simmons:

"Parental Alienation Syndrome has now morphed into Parental Alienation Disorder thanks to the fathers' rights organizations who are wildly pushing this through, and why wouldn't they? It benefits the abuser and discriminates against the victims of abuse, which are overwhelmingly women.
This gender specific, abuse excuse, junk science can not be allowed to enter
into the scientific community as there is nothing scientific about a
syndrome/disorder whose only symptoms are a uterus, divorce papers, and bruises.
I ask that you all to take action against legitimizing this outrageous theory by
e-mailing the APA and asking your groups to do the same."

I have a few concerns with Tracy Simmon's beliefs on the subject and a few beliefs of my own in response to her statement.

Tracy Simmons and NOW (and other like-minded idiots) who consider Parental Alienation a myth or some kind of made up illusion are either completely and ridiculously blind, or have a much deeper and sinister agenda.

Parental Alienation is real and it is child abuse; Those that deny this fact and fight to allow Parental Alienation to continue to harm parents and especially children, through bogus claims that it doesn't exist, are guilty of parental assault and CHILD ABUSE!

People need to realize that nothing is going to change in our family courts until the flow of big money is changed, and attorneys and judges are forced to fight and rule for the best interests of the children only. Changing words in codes and statutes doesn't change how judges rule when there is no accountability, wake up people! If they profited from ruling in the best interests of the children, well things would be much different!

Georgia, along with a few other sates, does not provide lawyers for indigent parents facing contempt hearings for failure to pay support.

Why Judicial Corruption is Invisible

We all would like to believe that, as when we were children in a family, there is in our society a final authority to whom we can turn in case we are seriously wronged. We are not predisposed to believe the accusers of the judicial process any more than the detractors of Santa Claus. Perhaps critics are merely sore losers or angry convicts, and perhaps judicial misconduct would be exposed by appeals courts or the mass media, and corrected. Why guess our way without the facts? Such pre-dispositions held by many otherwise educated adults allow pervasive institutional corruption of the judicial branch to remain hidden.

Judicial corruption is invisible to citizens, because lawyers are trained and motivated to deny and cannot safely speak of it, because mass media corporations agree with judicial prejudice and live in fear of judicial whims, because non-lawyers cannot obtain the facts without prohibitive cost and effort, and because the infantile myth of judicial salvation has broad appeal and is propagated as an opiate by the mass media. Judicial corruption is discovered by those of its victims willing to do years of tedious research, and only they will speak of it....

The IV-D program is grounded in both federal and state statutes as well as judicial rules and procedures. The Child Support Enforcement (CSE) within the Department of Health & Human Services of each state is the single state agency charged with administering the IV- D program in the respective states. The federal statutory basis for the program is U.S. Public Law 93-647, Title IV-D of the Social Security Act. Each state has a similar state statutory basis.

The policies and procedures that govern most aspects of the child support program in each state are the Code of Federal Regulations (CFR) in 45 CFR, Parts 232 and 301 to 308; state child support statutes; and state Rules of Court. Additionally, existing policies and procedures may be affected by case law as well as court and judicial proceedings.

No where in the Code of Federal Regulations or Federal Child Support statutes (42 U.S.C. Sections 659-671) does it allow for the incarceration/imprisonment of anyone for child support debts.

Divorced father loses custody of his three children 'because he's agnostic'

A divorced father-of-three claims he has lost custody of his children because he's agnostic.

Craig Scarberry, of Indianapolis, Indiana, had shared equal custody of his three young children with his former wife, a practising Christian, for four years.

Then last month a judge ruled the Navy veteran's visitation time be limited to four hours each week and custody reduced to once every other weekend.

Mr Scarberry said the only possible reason he can find in the ruling for the judge's decision is his comment that 'the father did not participate in the same religious training as the mother... father was agnostic.'

The ruling also stated: 'When the father considered himself a Christian, the parties were able to communicate relatively effectively.'

Child support not related to driving

Targeting parents who owe child support by suspending their driver's licenses is a farce.

Maybe we need to be careful what we do. "The road to hell is paved with good intentions."

Might we be creating increased social problems?

Sure, impound drivers for driving-related offences and behavior.

But the alarm is the licence suspension or vehicle impoundment for non-payment of child support.

There is no relationship between the two matters. We can't punish a non-driver equally, so is it unconstitutional?

This is pure bullying, at which the government is prolific.

Impounding or suspending might cause loss of employment and hurt the children more. Dumb.

Some parental splits are caused by the custodial parent, this suspension may escalate retaliation or generate counter-violence.

This law is morally wrong and poorly thought out. Judges need to consider it invalid.

The social costs of such a law will only increase everyone's tax bill--in direct contravention to the government's lies that
passing such draconian child support laws will save taxpayers money. Government has never saved taxpayers any money:

Family law courts in the United States are a disgusting and abusive mess. While we can’t blame it all on the judges as many problems are caused by lying litigants, the judges are ultimately responsible for most of the problems. They should be upholding the law, ensuring that people’s rights are not violated, and requiring reasonable proof of allegations before they are acted upon. But in the United States today, that’s not the function of family law judges.

Family Law Judges Rubber-Stamp Civil Rights Abuses

Today’s family law judges are generally rubber stamps for civil rights abuses. It is routine for due process to be violated. Unequal protection by the law is the norm. The judges generally think this is all OK because family law courts aren’t criminal courts.

Judges complain they don’t have enough time to handle the numerous cases they have. They complain about budget cuts. They complain about needless litigation. Whose fault is all of that? They should look themselves in their mirrors as they have created the problems that have lead to the family law courts being overwhelmed with destructive litigation.

Family Law Courts Reward Criminals, Punish Victims

For starters, their failure to punish perjury results in massive increases in court hearings. It also results in far more complicated cases in which innocent parties who are being truthful are abused by lying litigants with the assistance of incompetent judges. And all of this adds up to spiraling legal costs which often don’t end until after all of the marital assets are depleted.

The judges who don’t punish perjury are often the same incompetent judges who think they can tell the truth without reading court filings and without strong evidentiary standards. Such judges are enablers and co-conspirators of government abuse against honest people. They may argue that they "don’t have time to punish perjury", but their arguments are invalid. Failure to punish perjury guarantees there will be a lot more of it and that injustices, countless unwarranted court hearings, and abuse of innocent children and parents will be the norm. Failure to punish perjury means the load on the family court system is higher than it would have been if perjury was punished all the way along.

Because incompetent judges reward perjury, dishonest litigants quickly learn that whenever they are unhappy, all they have to do is make up a new set of lies and tell it to the judge who, in his or her "exercising extreme caution" will likely violate the US Constitution, throw due process out the window, and strip those falsely accused by family court liars of their rights.

Typical Family Law Abuses Include "Kick Out" Orders

The victims often don’t even know destruction is coming until after they are served with papers kicking them out of their homes and banning them from seeing their children. Their "due process" consists of being persecuted and severely harmed prior to a chance to defend themselves from false accusations, often months and sometimes years later. And those are the ones who can afford attorneys — many others can’t and have their civil rights totally trampled as the lying ex, her or his attorney, and the incompetent judge skewer people who are already badly harmed and weakened by severe financial and psychological damage caused by the aggression, dishonesty, and lawlessness shown towards them.

Courts Ban Parents From Seeing Children Without Due Process

What rights do people lose because of incompetent judges? They usually lose their access to their children and most of their income for "child support" payments calculated with zero custody time based upon false accusations. Add to those falsely obtained child support payments the horrendously expensive supervised visitations that can cost more than a person makes per month, often at $30 to $100 (or more!) per hour, to be watched like a hawk by strangers while they are with their children. This can last for months or years, bankrupting these victims and eventually meaning they can no longer afford to see their children. Then the courts are likely to rule that they will continue to have zero custody because they didn’t care enough to see their children!

Courts Encourage Financial Victimization by Aggressor Spouses

It’s also common to be kicked out of one’s home with no advance notice. As a result, one may lose all of his or her property for months or years or forever. When this is brought up in court, the judges whine about how they can’t talk about property issues until the end of the divorce case. By then, likely years later, much or all of the property will have been lost, destroyed, sold, and stolen — hmm, it was all already stolen with help of the court — stolen yet again. All of this can’t really be proven because the liar who requested the court to abuse his or her ex didn’t document what the property was, the victim didn’t have a chance to do so, either, and the court will seldom if ever require such documentation and seldom if ever gets neutral third parties to create it. Even if they did, they would provide ample time for the liar to make property disappear prior to a neutral third party showing up to photograph or videotape the property.

Further compounding the damage, the debt on the home one can no longer enter or approach and property which one can no longer have is often ordered to be paid for by the victim of family law courts. The lying ex will be living in it, possibly with the person with whom he or she had an affair. But the victim will be paying for 50% or more of it, sometimes even 100%.

How to Report Bad Family Law Judges

None of this is going to change unless the courts and specifically the judges are held accountable for their incompetent and abusive actions.

How are we, the victims of family law courts, supposed to hold judges accountable?

Generally speaking, except for extreme abuses, it does not appear that state judicial boards take most complaints seriously. However, if they receive massive quantities of detailed complaints about a judge, perhaps they will take note.

You can find similarly abused parties in your area and protest the court. Picket it. Be sure to put the name of the abusive judge on big signs when you picket the courthouse. Although death threats may seem appropriate, don’t use them because you might end up with local law enforcement causing even more trouble for you.

Campaign Against Bad Family Law Judges

Most judges at some point have to run for re-election. You can campaign against them. Rally together with people who have been abused to hold them accountable and ensure they are not re-elected. Expose their dirty laundry during the election. Even if it does not affect that particular election, if enough of this is done consistently, it will probably result in candidates in future elections focusing on compliance with US law, punishment of perjury and contempt of court, and use of evidentiary standards of at least "clear and convincing evidence" before people’s rights are stripped away.

It’s up to those abused by the courts to force change. That’s because politicians don’t care and most people have no clue how evil the family law courts in this country have become. They won’t find out until they end up in them, and that’s too late to do much to force change as then they are in the middle of a war that will likely destroy their lives.

American men are being outlawed by Bills of Attainder or by the lesser bills of pains and penalties. Men are being outlawed in society through the use of such bills of attainder *(bills of pains and penalties), where a man cannot have or own guns, own property, own his children, control his life, have the right to travel, have a bank account, or a passport, or vote, or enter government for welfare services, or enter the courts for justice, etc., etc., ad ifinitum, ad nauseum...

The Constitution for the United States of America, Article I, Section 9 says that the U.S. Congress CANNOT pass any Bill of Attainder. The Constitution, Article I, Section 10, says that NO State shall pass any Bill of Attainder. The Constitution was very specific that neither the Federal government or the State governments could pass any bills of attainder, or bills of pains and penalties. Bills of Attainder or Pains and Penalties were devised by the British to punish individuals or easily ascertainable members of groups. It was a legislative attack on members of society, similar to what occurred during the Spanish Inquisition. Under the Spanish Inquisition and British Bills of Attainder, a person could have their property seized, forced into debt, their families taken from them, imprisoned for debt for the rest of their lives, and even executed in order to seize their wealth, assets or even family. We threw the British out of this country for doing this.

Yet, today, we have our socialist Congress and socialist state legislature passing bills of attainders and bills of pains and penalties known as domestic violence laws (outlawing men by denying them any vestige of due process), imprisoning men for debt under the guise of child support enforcement (even though federal and state courts say that child support is a common civil matter and that probable cause that a crime has been committed must exist for a warrant of arrest to issue), supervised visitation laws to deny and deprive men of their God-given rights to their own children by a draconian court system hell bent on stealing our children for profit. The list goes on.

In the 1950's and 1960's the Supreme Court of the United States (SCOTUS) ruled numerous times that the government could not discriminate against people who were members of the communist party in this country, otherwise it was considered a bill of attainder. Today, our communist-socialist form of government is discriminating against men by denying them their basic fundamentally secured rights.

It is clear: American males are under attack by our socialist-leftists in government who control Congress, state legislatures and most state agencies. Men have been intentionally culled out of American society. Men are being hunted and removed from society (civilly murdered) for profit and power.

It is only American men (not women) who are overtly attacked, and persecuted by government. "IF" government treated women equally, it is a fact, that the government welfare system (instituted by socialist Democrats starting with President Franklin Roosevelt and then Lyndon Johnson, and most recently Bill Clinton), would be incredibly incapacitated. "IF" women had to undergo the same, exact hardships men are put through, then; they would not enter the agencies which so readily serve them (and turns away fathers). If women couldn't easily and readily walk into government services and get their "thirty pieces of silver", they wouldn't go at all. Thereby, there MUST be the least amount of restrictions placed against them, and the maximum (and strict construction of the law) placed against men.

First, it is rare that fathers even attempt this sort of thing, (asking for government help) so, the system is ingrained to serve the woman from the first instance. Not men.

Secondly, this government has illegally given women SUPER RIGHTS which are not allowed by law, and which are only given to women.

Thirdly, this government and the panoply of agencies which serve it, have established and are implementing a 'proactive' attack against males in general and Fathers, specifically. Period. We have more men now suffering from PTSD (Post Traumatic Stress Disorder) than in any time in human history....NOT because of any declared war...but rather, because of the UNDECLARED WAR, which has been effected upon them.

Fourthly, American males are wilfully and criminally become labelled as the 'new jews.' We are the 'new' niggers of society. We have no rights but you better believe women have SUPER RIGHTS throughout the panoply of government services. This can be readily seen by three things:

a.) Birth rates.
b.) Homosexuality identity issues
c.) Decline of Population
d.) Decline in Civilization.

Women can get welfare, housing, social security benefits, food stamps, "mad money", and more through the government largesse. Now, illegal immigrants are getting the same treatment. But, men, they get nothing. It takes years for men to get social security benefits when they are disabled. It takes years, if they are lucky, to get welfare or housing. Forget about food stamps and the like. If a man owes child support, he cannot get housing, food stamps, or even a job. Men are being ostracized and outlawed from society. They are being made criminals without any criminality. It's only because they are a man that they are guilty.

American men, directly due to this undeclared war, are not propagating our American society any longer. These figures are roughly true: that we need 2.8 births per thousand to have a "normal' replenishment rate of the populace. It takes roughly 2.3 births per thousand to have ZERO population growth. America for the past six to seven decades has suffered a 1.3 birthrate per 1000, which means we are dying out as a population.

This has huge repercussions. Russia has also suffered a similar depletion of its populace directly due to the same reasons: Russian men were under attack by socialist theory implemented by a communist government (no rights to private property), men were marginalized by government for almost 80 years, then they refused to work or participate in the government, which ended the soviet union. Now, the populace is depleted, and they whole society is facing epidemic social crisis due to the underpopulated Russian empire, which now cannot coalesce directly due to the fact, that they have a sectionalized population that has no knowledge of itself. Will and Ariel Durant documented a similar epistemology when they documented the rise and fall of the Roman Empire two-thousand years ago. Because Rome had been over-run by Huns, Visigoths and other denizens, NOBODY KNEW WHAT IT MEANT TO ACTUALLY BE ROMAN, and thereby, the society died.

This is now being documented in America, where burgeoning numbers of illegal aliens are INTENTIONALLY allowed by our government to infest this nation, directly due to the fact, that we are not replenishing our stock with American people. These new denizens have no cognizance of what it means to be an American, which is exactly what this new socialist/totalitarian regime wants.

Government no longer is getting American Citizens to replace the workforce, no problem. Flood the society with illegal aliens. (This is better, because the illegal aliens will NOT keep the government in alignment as American Citizens would).

You can document the apartheid against the American male by homosexuality rates. Because men are under overt attack, many men within the populace have 'turned' into homosexuals and transvestites, of which those numbers (and the operations supporting sex change) have exploded. Those men do these changes, because they directly understand (at least their subconscious does) that they are being hunted and marginalized BY A GREATER POWER THAN THEMSELVES (e.g. "Tyranny of the Majority). Thereby, they seek the SAFETY of 'crossing over' into the other sexual identity, where there is no conflict with government. I will bet you dollars to donuts that "IF" a man who entered the government welfare system asking for assistance was a TRANSVESTITE, he would be immediately granted such entitlements. There would be no such 'requirement' that he produce a lawful court order, or have to jump through hoops to produce reams of documentation to show he is disabled or, indeed, in need of welfare.

Just by the mere fact that the socialist Democrat party, starting with President Lyndon Johnson turned Social Security from a trust fund into a "cash cow" second payroll/income tax, men have been disenfranchised. Why? Because men put the largest amount of Social Security payments into the system. Based on calculations from various websites found after doing a Google search on "Social Security IOUs", it has been carefully estimated that the socialist Democrat run government has stolen between $25 TRILLION to $50 TRILLION (that's with a "T") over the past 40 years. If that money had been left alone, every man, woman and child in this country could retire on over $10,000 per month from just the interest on the Social Security Trust Fund.

But our socialist-Democratic party stole that money and have squandered it to the point that the government is now financially broke. The government is now making men pay for it by being subjected and defrauded under what is euphemistically called "child custody" laws, child support enforcement, domestic violence "prevention" and other socialist-communist ideologies. Yes, you read that right--"communist ideologies". Where do you think no fault divorce and child support enforcement come from? Soviet Family Law Articles. Domestic violence is also a communist program.

Our nation is being silently turned into a fully communist totalitarian state. Sad thing is, that men cannot even use the courts in this country to assert rights. If "he" sued and went to court--they'd never hear it. The courts are gone, the government is gone, the Domestic Enemy running this nation has a "Village" agenda you have no comprehension of--and IF you show them the law, the Constitution or anything else, they will disregard it.

These people are openly implementing tyranny, they have knowledge of the law, and could care less. They are going to do what they are going to do, and treason be damned: they are not coming back.

Men have attempted for years to do the right thing; the legal thing. They have gotten nowhere against treasonous public officials. The only thing left to deal with treason is to implement a military overthrow of the government (since men constitute most of the military), or invoke the Second Amendment to throw out the present government.

Another Child Support Nightmare

This is actually more common than one would imagine.

"I haven't been able to talk to my kids in a few months. It's gotten to the
point where even I feel embarrassed. I feel like a deadbeat dad." But Robert
Henos swears he isn't. He says since last October his employer, Advanced Cleanup
Technologies Inc., has been taking money out of his paycheck for his child
support payments, but hasn't handed the money over to the state.

His paychecks show that money for child support is taken out of his check regularly.
The check from two months ago shows that more than $7,000 was taken out from
January until July. But according to a statement from the California Department
of Child Support Services, Henos is behind more than $13,000 on his payments.
"Where's my money, where's my kids' money?"

Judge in trouble for yelling at mom who interferes with visitation.

Atlantic County Superior Court judge - accused of screaming at a woman during a custody hearing - apologizes but denies ethics violation

Judges scream at yell at dads all the time for being behind on child support (even if it is beyond the dad's control such as layoffs, underemployment, and/or ridiculous orders that are completely beyond their ability to afford).

But yet this Judge because he yelled at a mother for interfering with custody, he is now threatened with ethics violations! Can you say. "DOUBLE STANDARDS" ????

An Atlantic County Superior Court judge has apologized for his conduct in a
Family Court case that now has him facing ethics charges.

Judge Max Baker was charged last month with screaming at Dana Pilla during a
temporary custody hearing in December, and threatening to jail her if she did
not comply with his order. He faces a possible hearing before the Advisory
Committee on Judicial Conduct.
In his response, Baker denies he screamed at Pilla or called her a bad
parent, but "acknowledges that his words could have been so interpreted." He
says he was trying to get her to understand the detrimental nature of denying
the child's father access.
He "has sincerely apologized to Dana Pilla in writing, acknowledging that the
manner in which he spoke to her and the words he utilized were wrong and were
embarrassing to him," Baker's attorney, Mark Biel, wrote in his reply. The
apology "represents the unconditional recognition of inappropriateness of his
behavior."

If this Judge is removed for yelling at a mother for interfering with custody, all of the other judge's should be removed for their unethical and biased behavior towards fathers for being behind on child support etc. No more double standards period!!!!!

Child support and its Marxist Long Arm of the Law

Given that child support was created under the Social Security Act, just the
mere name "Social" Security is unequivocal evidence that child support
enforcement is an unconstitutional Marxist program being used to divest one
party of their assets and wealth in a Marxist-Communist redistribution scheme
that is anti-thetical to our form of government and the United States
Constitution. This unconstitutional law, being a Marxist-Communist ideology put
into practice, violates the Oaths of Office of every public official, including
judges, child support caseworkers, law enforcement and politicians involved in
child support enforcement and collections. It violates their Oaths of Office
because their oaths are known as loyalty/fidelity oaths that imposes on federal
and state officials an oath of loyalty or allegiance to the United States
Constitution and respective state constitutions.

These Oaths of Office
gives full recognition and acknowledgement of individual rights, immunities and
privileges constitutionally guaranteed which must be in accord with these Oaths
of Office as a condition of public employment. Any violation of this Oath of
Office results in immediate termination of the public official by and through
charges of felony Official Misconduct, Impeachment, or other criminal and civil
actions.

A requirement that public employees/officials take an oath that
they will not only uphold and defend the state and federal constitutions, but
also that they will oppose the overthrow of the government by force, violence,
or any illegal or unconstitutional method, is valid.

Therefore, based on
the fact that the child support bureaucracy foments anti-American Marxist
ideology through redistribution of wealth practices, it is a not-so-subtle
method of overthrowing our form of government--a Constitutional Republic run by
We the People; not a Marxist-Socialist Oligarchy run by lawyers and judges, with
their strong-arm law enforcement bullies.

Child Support and its Marxist Long Arm of the Law

There are three things you can count on as a divorced parent: death, taxes, and child support. If you are the custodial parent of your children, support is in the form of buying clothes, food, medicine, and the ten thousand other items children need. If you are the non-custodial parent, child support is in the form of cash. And with the latest web of laws in each state, the payment of child support is something you can count on paying.

In the not-too-distant past, rumors of deadbeat parents were common. Most people have heard tales from friends, family, or relatives about a mother or father that got away without paying support. Even in cases where child support was ordered by a divorce court, the parent simply escaped the obligation by moving to another state. Eventually, some went to jail. Some ended up paying. But a significant number of deadbeat parents never paid a dime in child support.

In 1975, the Federal Government entered the child support picture. Lawmakers created a Federal/State partnership known as a "compact" that would facilitate the collection of child support. Part D, Title IV of the Social Security Act was created to encourage and fund state programs for the collection of child support. The program is administered by the Federal Office of Child Support Enforcement, part of the Dept. of Health and Human Services.

The most visible effect of the federal program is the designation of child support enforcement agencies in each state. They are referred to as Title IV-D agencies, named after the federal statute created in 1975. Each state has a Title IV-D agency but the specific state agency that takes on this responsibility is different in each state. In Florida, the Florida Department of Revenue was declared the Title IV-D agency. To accomplish their goals, the Florida Dept. of Revenue opened up a child support enforcement branch, dedicated to carrying out the federal mandate.

The Florida Dept. of Revenue Child Support Enforcement Division initiates a new case upon the occurrence of one of several triggering events. The most common event is when a single or separated parent applies for state Medicaid benefits for their child. It could be subsidized food, medicine, housing, or other misc. benefits. When the parent first applies, they are required to sign a form authorizing the state to initiate child support proceedings. The public policy behind this mechanism is to minimize taxpayer support for children and to place child support responsibility where it belongs - on the mother and father of the child. After a parent applies for benefits, it is only a short matter of time before the Title IV-D agency initiates a child support lawsuit against the non-custodial parent.

Each state has a similar Title IV-D agency that establishes, collects, and enforces child support. The underlying federal law that authorizes the state agencies also requires nationwide coordination of child support efforts. The bottom line: an order for child support in Florida will be enforce by Ohio, California, New York, or any other state where the parent resides. The name of the specific agency is different in every state but the purpose is the same: to collect child support for the custodial parent. The enforcement options can be harsh on a parent who refuses to pay. "The Long Arm of the Law" is a well-named term for child support enforcement. Parents who get behind on child support can face the following sanctions: suspension of driver license, suspension of professional and trade licenses, forced sale of personal assets, and imprisonment. Frequently, a seriously delinquent payer of child support is sent to jail by the courts.

The system is efficient, wide reaching, and inevitable. The states have an efficient method for coordinating efforts and the parent who moves across the country can no longer avoid child support obligations. But like many laws, the web of rules, requirements, and harsh penalties ultimately benefit society. In this case the people who benefit are deserving: children of single parent households. Death and taxes are not longer the only inevitable thing in life. Now, parents in every state of the US can count on doing the right thing: paying child support to their children.

Why are they asking so much? Well, the obvious answer is because the
78-year-old Mr. Bren is loaded, with a net worth estimated by Forbes at $12
billion. Mr. Bren’s relationship with the girlfriend ended in 1997, and the suit
was filed in 2003.
"He’s paid millions of dollars, and now 15 years later [Ms. Gold is] coming out with an oral promise that she told no one about," Mr. Bren’s attorney told the Times. "She’s just trying to get more money out of him."

WASHINGTON PARK -- Carnell Williams didn't know it at the time, but a $250
federal stimulus check mailed last year that he never got to cash set off
government computer alarm bells that may doom him to a life of poverty.
The stimulus payment, intended for people with disabilities, was
automatically applied to Williams' unpaid child support. That transaction
alerted state officials, who had not been aware that Williams was getting a
disability check. They quickly filed paperwork that led to regular deductions
for unpaid child support from his $1,062 monthly federal disability payment. The
debt includes tens of thousands of dollars in interest.
Williams stated, "This is a life sentence. There is no statute of limitations
on owing child support. There is no probation. No parole. No nothing. I'll die
in poverty."

Family courts routinely deprive men of their fundamental right to parent their own children by charging them with a wide variety of trivial offenses. Family courts generally uphold feminist demands to kick a man out of his own home, and take control of their children and his money, based on a woman’s unsubstantiated allegations. A major weapon in this ongoing battle between men and women who don’t get along is the Violence Against Women Act. This law was passed in 1994 as a payoff to the radical feminists for helping to elect Bill Clinton President in 1992.

The Violence Against Women Act shows the hypocrisy of noisy feminist demands that we kowtow to their ideology of gender neutrality, to their claim that there is no difference between male and female, and to their opposition to stereotyping and gender profiling. There is nothing sex neutral about this law. It is based on the proposition that there are, indeed, innate gender differences: men are naturally batterers and women are naturally victims. This law is not designed to eliminate or punish violence, but to punish only alleged violence against women. Most of the shelters financed by the Violence Against Women Act do not accept men as victims.

This law has been known from the getgo as “feminist pork” because it puts $1 Billion a year of U.S. taxpayers’ money into the hands of the radical feminists. They have set up shop in domestic violence shelters where they promote divorce, marriage breakup, hatred of men, and false accusations, while rejecting marriage counseling, reconciliation, drug-abuse treatment, and evidence of mutual-partner abuse. There is no accountability for the taxpayers’ money spent in these shelters. This law provides the woman with free legal counsel to pursue her allegations, but not the man to defend himself. He is on his own to find and pay a lawyer.

Domestic Violence Center Shut Down for Being a Total Fraud

A Fulton-based resource center for battered women has been ordered by the state to shut down all operations. This shouldn't be terribly difficult since the Battered Mother's Resource Fund (BMRF) never actually did anything anyway.

Missouri Attorney General Chris Koster said in a news release that the BMRF, which is owned by Phillip Baney, solicited donations to help victims of domestic violence, but never actually implemented any of the programs it advertised, including community outreach seminars, a national database of shelters and other organizations that provided assistance to battered women and children, a Mother's Assistance Fund and a ranch for kids who had been harmed by domestic violence.

"Most heart wrenching is that BMRF may have prevented domestic violence victims from reaching out for legitimate assistance by claiming that most domestic violence shelters separate mothers from their children," Koster said in the press release. "This is not true and it is a dangerous statement that could keep a domestic violence victim from seeking assistance for fear of losing her children. Every domestic violence shelter in Missouri accepts children."

BMFR's crisis hotline was not a total fraud, though it did not operate 24 hours as advertised, and the toll-free number shared a telephone line with Baney's home phone and Internet connection. It's staffed sporadically by Baney, his wife and a neighbor, none of whom have any training or experience in helping domestic violence victims.

Koster ordered BMFR to shut down its website and stop soliciting donations immediately. Baney has until October 31 to dissolve BMFR as a corporate entity.

BMFR's official domain name, www.batteredmothers.org, expired July 9, but it still maintains a site on MySpace.

Visitation rights must be enforced

Clear and convincing proof that money is more important than a father/child relationship and our family courts are being backed by a gender political agenda.

Sounds all fine and dandy, but how many Judges and Attorneys follow these plans? There's no money in it for them. The more warring between parents the more the attorneys make, and Judges and States secure pensions and Title IV-D funding by avoiding 50/50 custody. Title IV-D and the gender political family courts need a major overhaul period.

It's all about business and how to make the most profits off of the parents folks. The meaning of the "best interest of the children" is highly distorted and twisted in our family courts today.(Often times completely ignored).

We are all being used as pawns for profit, especially our children.

Foster care homes cited for unspeakable abuses across Georgia

The state has also depended on these private agencies to supervise much of the care the children receive. The result has been appalling. A recent investigation by the Atlanta Journal Constitution revealed that incidents of rape, molestation, assault, neglect, abuse and suicide attempts are regular occurrences at many of the group and foster homes across Georgia.

It's not a crime to owe money, and debtors' prisons were abolished in the United States in the 19th century. But people are routinely being thrown in jail for failing to pay debts. Ex-Wife Ordered Jailed for Alienating Children From Father

A Long Island, N.Y., judge has sentenced a woman to six weekends in jail for repeatedly undermining her ex-husband's relationship with their two daughters.

Supreme Court Justice Robert A. Ross in Nassau County ruled that the mother, Lauren R., willfully violated a court order by deliberately alienating the elementary school-age children from her ex-husband, Ted R.

Ross held Ms. R. in civil contempt and ordered her to report to the Nassau County Correctional Facility every other weekend this summer.

Her term was to have begun on Friday, but was temporarily stayed pending appeal by a judge from the Appellate Division, 2nd Department, on Thursday.

"The evidence before me demonstrates a pattern of willful and calculated violations of the clear and express dictates of the parties' Stipulation of Settlement," Ross wrote in Lauren R. v. Ted R., 203699-02.

"The extensive record is replete with instances of attempts to undermine the relationship between the children and their father and replace him with her new husband, manipulation of defendant's parenting access, utter and unfettered vilification of the defendant to the children, false reporting of sexual misconduct without any semblance of 'good faith,' and her imposition upon the children to fear her tirades and punishment if they embrace the relationship they want to have with their father."

The extraordinary hearing to determine whether Ms. R. should be held in contempt for violating the couple's stipulation of settlement began in May 2009 and stretched over 23 days of hearings over the next nine months.

During the hearing, Mr. R. testified to dozens of occasions in which his ex-wife either interfered with his visitation rights or purposefully alienated the children from him.

The judge described about a dozen such incidents or patterns in his eight-page decision.

In the winter of 2007, for example, Ms. R. prevented Mr. R. from seeing his daughters for six weeks, Ross wrote.
"I observed the plaintiff smirk in the courtroom as defendant emotionally related how he was deprived of spending Hanukkah with his children, and was relegated to lighting a menorah and watching his daughters open their grandparents' presents in the back of his truck at the base of plaintiff's driveway," the judge wrote.

Mr. R. also testified that Ms. R. consistently scheduled theater outings and social activities with her children so that they would conflict with his visitation, thereby putting him in the position of either consenting to a missed visit or risking disappointing his daughters.

The "crescendo" of Ms. R.'s contempt involved false accusations of sexual abuse against Mr. R., the judge wrote.
"Allegations that defendant had injured the child were found to be baseless and, by making such allegations, plaintiff needlessly subjected the child to an investigation by Child Protective Services, placing her own interests above those of the child," Ross wrote. "This report was not made in 'good faith' -- rather, the investigating agency warned the mother not to re-utilize the allegations and her children in her custodial litigation with the defendant."

In addition to the contempt finding and the temporarily stayed jail sentence, Ross ordered a hearing to consider a change of custody and to hear Mr. R.'s application for more than $134,000 in attorney fees. Those hearings were postponed pending Ms. R.'s appeal.

Ms. R.'s attorney, Kieth I. Rieger of Barrocas & Rieger in Garden City, N.Y., praised Ross, but criticized the decision, likening it to last week's missed umpire call that cost a Detroit Tigers pitcher a perfect game.
"I think all of us make mistakes, and I think he's just made a good-faith, honest mistake in his assessment of this case," Rieger said. "That's why there's an Appellate Division. I think he just did not accurately assess my client."
Stanley Hirsch, also of Garden City, represented Mr. R.

"I'm very hopeful that this case will be some type of warning to those who don't have the children's best interests at heart when they conduct themselves with their spouses," Hirsch said. "It has great significance to my client, but I think it has a terrific overall impact on people who are going through a divorce and not getting along and involving the children in their disputes."

Judge is NOT a court, he is only an officer of the court

Each element constitutes fraud upon the court in the U.S., when an officer of the court is found to have fraudulently presented facts to court so that the court is impaired in the impartial performance of its legal task, the act, known as "fraud upon the court", is a crime deemed so severe and fundamentally opposed to the operation of justice that it is not subject to any statute of limitation.

A judge is not a court; he is under law an officer of the court, and he must not engage in any action to deceive the court. Trans Aero Inc. v. LaFuerga Area Boliviana, 24 F.3d 457 (2nd Cir. 1994); Bulloch v. United States, 763 F.2d 1115, 1121 (10th Cir. 1985) (fraud upon the court exists "where the judge has not performed his judicial duties").

"Fraud upon the court" makes void the orders and judgments of that court. The U.S. Supreme Court has consistently held that a void order is void at all times, does not have to be reversed or vacated by a judge, cannot be made valid by any judge, nor does it gain validity by the passage of time. The order is void ab initio. Vallely v. Northern Fire & Marine Ins. Co., 254 U.S. 348, 41 S.Ct. 116 (1920). "Fraud destroys the validity of everything into which it enters," Nudd v. Burrows (1875), 91 US 426, 23 Led 286,290; particularly when "a judge himself is a party to the fraud," Cone v. Harris (Okl. 1924), 230 P. 721, 723. Windsor v. McVeigh (1876), 93 US 276, 23 Led 914, 918.

Judge Anne McDonnell relies on N.J.S.A. 59:3-2(b) which states "A public employee is not liable for legislative or judicial action or inaction, or administrative action or inaction of a legislative or judicial nature".

But since defendant Merlo is conducting evaluation as a Court Psychologist without the proper license, educational requirements pursuant to the "Revised Notice of Vacancy" or the educational requirements of a Doctorate Degree which is law in New Jersey and stated within the educational requirements pursuant to the "Board" which is a criminal violation pursuant to N.J.S.A. 2C:21-17 Impersonation; theft of identity; crime, defendant Merlo stated on her risk assessment that I needed to be medicated which is violation of N.J.S.A. 2C:21-20 Unlicensed practice of medicine, surgery, podiatric medicine, crime of third degree, then the following Tort Claim Act statutes apply; N.J.S.A. 59:2-2(a) Acts By Public Employees: A public entity is liable for any injury proximately caused by an act or omission of a public employee within the scope of his/her employment in the same manner and to the same extent as a private individual under like circumstances. (b) If the public employee is not liable than the public entity is not liable either; N.J.S.A. 59:3-1(a). Liability and Immunity of Public Employees: A public employee is liable for any injuries caused by his acts or omissions to the same extent as a private person, notwithstanding the exception provided by the Act; and N.J.S.A. 59:3-14(a) Public Employee Immunity Exception: Nothing in this act exonerates an employee from liability if it is established that his conduct was outside the scope of his employment or constituted a crime, actual fraud, actual malice or willful misconduct. (b) Nothing in this act shall exonerate a public employee from the full measure of recovery applicable to a person in the private sector if it is established that his conduct was outside the scope of his employment or constituted a crime, actual fraud, actual malice or willful misconduct.

The Tort Claims Act provides for protection of a public employee from liability for injury "resulting from the exercise of judgment or discretion vested in him." (N.J.S.A. 59:3-2(a)). A public official’s good faith exercise of judgment and discretion in the performance of his duties has been accorded limited immunity by the courts of this State. Burke v. Deiner, 97 N.J. 465, 472-473 (1984); Visidor Corporation v. Borough of Cliffside Park, 48 N.J. 214, 221 (1966).

This protection is circumscribed, however; public employees may not act in complete disregard for the rights of others. There is a public employee immunity exception found in N.J.S.A. 59:3-14. See also, Burke v. Deiner, supra, at 472-473. "Nothing in this act shall exonerate a public employee from the full measure of recovery applicable to a person in the private sector if it is established that his conduct was outside the scope of his employment or constituted a crime, actual fraud, actual malice or willful misconduct."

It is the intent of this provision that a public employee guilty of outrageous conduct cannot avail himself of the limitations as to liability and damages contained in this act. (Emphasis added).

This 1972 Task Force Commentary contained in N.J.S.A. 59:3-14 represents a clear and unambiguous expression of legislative intent that a public employee should be deprived of any benefits such as TCA limitations on liability and damages for their "outrageous" conduct.

Courts have found such "outrageous" conduct, thereby removing the TCA defenses from public employees, in a multitude of circumstances, including claims for (1) assault and battery, Velez, supra; (2) malicious prosecution, James v. Price, 602 F. Supp. 843 (D. N. J. 1985); (3) knowing violation of drug prescription regulations, Taglieri v. Moss, 367 N.J. Super. 184 (App. Div. 2004); (4) false arrest, Dela Cruz v. Borough of Hillside, 365 N.J. Super. 127 (App. Div. 2004); and (5) torts based on reckless conduct, Jobes v. Evangelista, 2004 WL 1170507 (App. Div. 2004) and Alston v. City of Camden, 168 N.J. 170 (2001).

"Willful misconduct" has been defined as falling somewhere between simple negligence and the intentional infliction of harm. Alston v. City of Camden, 168 N.J. 170, 185 (2001). For example, the Supreme Court of New Jersey in Fielder v. Stonack, 141 N.J. 101, 123-127 (1995), defined "willful misconduct" as a knowing failure to follow specific orders. In Fielder, the court stated that "willful misconduct is ordinarily limited to a knowing violation of a specific command by a superior, or a standing order …" Id. at 125 (Emphasis added).

In Taglieri v. Moss, 367 N.J. Super. 184, 187 (App. Div. 2004), the court held that a physician’s knowing violation of regulations that controlled prescription drugs constituted "willful misconduct" as contemplated by N.J.S.A. 59:3-14, and therefore the verbal threshold provision of the TCA did not bar claims against the physician. The defendant argued that even if his conduct was "willful" as defined in N.J.S.A. 59:3-14, the verbal threshold barred recovery because the claimant could not establish a "permanent loss of bodily function, permanent disfigurement or dismemberment." Id. at 195-96. The Appellate Division rejected this argument and stated that, "N.J.S.A. 59:3-14(b) plainly states that "nothing" in this act "shall exonerate a public employee from the full measure of recovery applicable to a person in the private sector" if the employee has committed acts of "willful misconduct." Thus, N.J.S.A. 59:9-2(d) does not protect [the defendant], and … the verbal threshold [is] inapplicable..." Id. at 197-98. (Emphasis added).

"Reckless conduct" also deprives Defendants of any protections under the TCA, specifically its verbal threshold. In Dunlea v. Township of Belleville, 349 N.J. Super. 506, 512, 513 (App. Div. 2002), the Court held that, in order to defeat a claim of good faith immunity, it is sufficient that the plaintiff shows the defendant acted recklessly. (Emphasis added). In addition, in Alston v. City of Camden, 168 N.J. 170, 185 (2001), the Supreme Court of New Jersey articulated that "willful misconduct is the equivalent of reckless disregard for safety, which is more than an absence of good faith." (Emphasis added).

According to Prosser & Keeton on the Law of Torts, "reckless conduct" is defined as follows: "[A]n actor acts recklessly when he or she intentionally commits an act of an unreasonable character in disregard of a known or obvious risk that was so great as to make it highly probable that harm would follow, and which thus is usually accompanied by a conscious indifference to the consequences." §34 at 212 (5^{th Ed. 1984).

However, a lack of stated damages will not bar a claim if the damages are not known at the time the claim is presented. Dambro v. Union Cty. Pk. Comm., 130 N.J. Super 450, 458 (Law Div. 1986).

400 Arrest Warrants Issued for Not Paying $36.00 Child Support Fee

Marion County Resident Circuit Court Judge Kurt Lackey has signed arrest warrants for 400 people who have failed to pay their annual child support fee to the circuit clerk's office. Circuit Clerk Ronda Yates says those who had warrants issued against them have failed to comply with three notices to pay the 36-dollar annual fee, the last of which required an appearance in court in April for an explanation of why they failed to follow the court order.

Yates reports 1,460 who pay child support through the office initially received the payment orders this year. She says those who still want to pay the fee voluntarily and avoid potential arrest on a warrant can come to her office at the courthouse. Yates notes by doing so, they will also avoid paying extra fees associated with being booked into the Marion County Jail. She says while most of the fee notices are just for one year, several have been issued for multiple years of non-payment.

The 36-dollar annual fee levied on divorce cases is used to pay maintenance costs associated with maintaining the records and also pay the salary of the child support clerk. Yates is thanking her staff members involved in the lengthy process of preparing the series of notices and the arrest warrants.

Child Support Is A For-Profit Government Fraud

We hear the term "Deadbeat Dad" thrown around like a household term around Mother's Day and Thanksgiving-Christmas holidays when our corporate government goes out and arrests men (in 96-98% of all child support cases, men are the victims) for revenue collection. So, I ask the question, "Who's a "deadbeat dad"? Someone who can't or won't pay child support? Who can't pay? There are a lot of fathers out there who've lost their jobs thanks to our government meddling into the banking and mortgage businesses, and now the car businesses. Government, with its lapdog press, like to pick on groups of people to create animosity and divisiveness. It's time to show the government for the real "deadbeat" that it is.

According to a 7-year study done by Arizona State University Professor Sanford Braver, Ph.D., which resulted in his book, "Divorced Dads--Shattering the Myths", he found that less than 5% of those that owed child support are true deadbeat dads-the ones with the younger trophy wives and sports cars, who don't want to pay anything. The truth of the matter, is that according to the Federal Gov't. General Accounting Office, Report # GAO/HRD-92-39FS, pg. 19, over 66% of those owing child support can't pay because they are unemployed, underemployed, disabled, dead, and in some cases the mothers don't want support.

Family Court Judges order such onerous child support amounts in some cases, along with alimony, daycare, medical expenses, and other expenses, that the father can't survive. He ends up becoming despondent, leaves his job and drops out of sight. He loses all contact with his child(ren) as a result. This is the government's ultimate goal. Breaking up of father-headed families (and then mother-headed ones when there are no more fathers, wherein, the government will come for the children without any resistance). Government is inducing a "welfare state" by forcing families apart, keeping fathers away, giving all entitlements to mothers and the children, except there is one difference. Instead of taxpayers being "ripped off" to the tune of welfare, divorced fathers are ordered, at the point of a gun, to pay for court-ordered "welfare" for the mothers and children that the government ripped asunder. Government doesn't do anything for altruism. They always have a motive behind what they do and the laws they make. It's all about money, power and control.

Recently it has been evidenced that "destruction-of-the-family court" judges refuse to reduce child support and alimony when a man loses his job because of the current economic climate. They tell the guy that it's too soon to reduce support because "you might get another job" in a short time. Most often the guy never gets the same-salaried position and winds up making substantially less. All the while, he falls farther and farther behind, with no hope of ever making up the arrearages.

But, do the courts reduce support? No. They keep it there until the arrears are so high, that the guy's credit is ruined, his driver's and professional licenses are suspended or revoked (which is totally counterproductive in that if one cannot work, how can one pay court-ordered obligations?!?!?!?), and they start putting warrants out for his arrest, even though he did everything he was supposed to do by law.

Judges then use detainers to hold the men in jail, somewhat like bail. But, it isn't bail, because child support is a CIVIL debt. Detainers to keep the men in jail until they pay? STUPID IS AS STUPID DOES! It's not about the children! Keeping a man in jail to pay support is an oxymoron. And, most Family Court judges are morons! How does one pay child support if in jail? Does he work in the jail making $10, $15, $20/hr. and have his wages garnished? Does this person invoke the INSOLVENT DEBTORS STATUTES when he gets out of jail, since he has no assets or income, and the jailing served as the remedy for the debt owed? Under the INSOLVENT DEBTORS STATUTES, the debt has been paid once the person has been jailed for it and released. But, the state will try and keep the arrears on the books. The reason for this: Because judges are granting such high orders and enforcing them stringently because the Federal government pays the states what is known as federal reimbursement incentive funding (Title 42 USC Section 658a) for amounts awarded, collected and enforced. This money goes into the state coffers, no strings attached (42 USC Section 658f). The first things paid out of state treasuries are judicial salaries and pensions and state employee salaries and pensions (along with bonuses and bounties for child support amounts awarded and collected).

This is a major unconstitutional conflict-of-interest that has been outlawed by the US Supreme Court in Tumey v. Ohio, Ward v. Monroeville, Gibson v. Berryhill and other cases. The Supreme Court held that judges and officials (i.e., child support officials and workers) who sit in judgment of cases that they have a financial interest in, are too tempted to abuse their contempt powers to jail unsuspecting litigants-taxpayers to extort/extract more and more monies out of them to increase the amount of funding, and ultimately increase their salaries and pensions.

Yet, family court judges continue to thumb their noses at these US Supreme Court mandates. This is not only contempt of the US Supreme Court, but felony official misconduct by judges, who are public officials that swore an oath to uphold, support and defend the U.S. Constitution and their respective state constitutions. By refusing to disqualify themselves from these cases, where they have a financial interest in the outcome of them, the Supreme Court has held that these judicial orders are essentially null and void and have no effect or force.

Some will say that if we don't have judges or hearing officers to enforce orders, how then will they be enforced? As taxpayers and voters who are paying taxes to have these officials usurp and violate our constitutionally protected rights, that is not our problem. The government made the situation. They must fix it. They can fix it by empanelling a group of people that have no financial interest (for example, economists, vocational experts, marriage experts, accountants, psychologists, even lawyers and retired judges). But, they cannot use arbitrary and capricious contempt powers to imprison for debt, and to re-institute peonage and forced labor, in violation of the Thirteenth Amendment of the US Constitution (prohibition against involuntary servitude), and in violation of Federal Criminal laws, Title 18 USC Sections 1581 and 1589 (Peonage; Forced labor).

Anyone arrested on one of these child support arrearage orders is being arrested on a fraudulent order; being arrested on a CIVIL matter. The U.S. Court of Appeals (2nd highest courts in the land) as well as the US Supreme Ct. hold that one can't be arrested on a CIVIL matter because there is no 4th Amendment probable cause that a crime has been committed to issue an arrest warrant. See, Stevens v. Rose (9th Cir. 2002), Allen v. City of Portland (9th Cir. 1995), Wooley v. City of Baton Rouge (5th Cir. 2000), Peterson v. City of Plymouth (8th Cir. 1995), Moore v. Marketplace Rest.(7th Cir. 1985), Paff v. Kaltenbach (3rd Cir. 2000). Also, included is the Third Circuit U.S. Court of Appeals case of U.S. v. Parker, 108 F.3d 28, 30-31 (3rd Cir. 1997)(child support a civil, commercial debt). In U.S. v. Lewko, 269 F.3d 64, 68-69 (1st Cir. 2001), the First Circuit U.S. Court of Appeals held that child support is nothing more than a common civil, commercial debt, and that it is NOT any "special kind of debt". Again, another fraud perpetrated by government officials. Every other Circuit has followed suit and hold that child support is a common commercial, civil debt.

The child support industry is a total fraud. It is a $5-$10 BILLION per year INDUSTRY that, if eliminated, the monies saved and sent to the children that supposedly need it, would wipe out all child support arrears in the US at one time. All that would be needed to do is send the BILLIONS in the form of a Social Security check or wire transfer, since child support enforcement laws are part of the Social Security Act.

Lastly, fathers will find an unusual way to pay their child support. They will sue the sheriff's officers and sheriff's departments, child support enforcement dept's. (because child support enforcement workers sought warrants when they are neither attorneys, nor were those arrested ever on probation). They will sue for Civil Rights Damages and for FALSE ARREST, ASSAULT, AND FALSE IMPRISONMENT FOR DEBT (In the New Jersey Constitution, Article I, Section 13, it prohibits Imprisonment for Debt in ANY action; every other state has such a prohibition, and 18 U.S.C. Sections 1581 and 1589 prohibit involuntary servitude by taking someone under government threat and making them work for someone else to pay off a debt). It is common knowledge that even if the state can't collect the child support, the state will be paid for the uncollectible debt by the Federal government. This insures a win-win situation for the state. They collect if the child support obligor pays, and they collect if he doesn't. Child support has long since stopped being about supporting children or relieving taxpayers of the welfare burden. It has now become a lucrative "REVENUE STREAM" for the states, bringing in hundreds of millions, if not billions, of dollars per year. In addition, it is a Communistic "TRANSFER OF WEALTH" scheme for the entitlement of women, lawyers and child support INDUSTRY. It is a discriminatory policy based on gender discrimination against men. Men account for 96-98% of all arrested in child support enforcement when they are in violation of child support orders. Some will claim that child support is not gender biased. If not, then why don't we hear about DEADBEAT MOMS, who fail to pay ordered support in over 65% of cases?

Before castigating fathers for not supporting their children, show concern for the corrupt courts who CREATE those fatherless children for profit. The judges and complicit politicians (who happen to be mostly lawyers who pass these anti-family laws), over the past thirty years, have trivialized fatherhood by giving sole custody to the mothers in 90(+)% of cases, denying fathers their due process rights, treating them like criminals, and separating them from their children in order to separate them from their money. Divorced, or single fathers have had fatherhood beaten out of them, and so, have no consideration for the responsibilities of siring children.

Neither is there any respect for marriage by the women bearing those children. Fatherlessness breeds sexual promiscuity. The socialist-liberals in the courts, the legislatures, and the editorial offices have created this national systemic problem. They have designed programs to throw money at the problem by using more enforcement processes. Those programs have the opposite affect from what was desired. Instead of slowing or stopping the problem, they made it WORSE, creating even MORE fatherlessness, and criminalizing more fathers. When you analyze the situation with an open mind, it may occur to you, as it has to many, that failure to pay child support might actually a rebellion against tyranny.

Some will say "it hurts the children" when you don't pay. It hurts the children when the custodial mother, supported and empowered by the courts and politicians, deprive the children of contract with their father, which, according to empirical studies and anecdotal stories, occurs 75% of the time. No wonder there is a lost generation of children out there. It's not an accident. It's by design. The government breaks up families for profit, gain, power and control.Remember that the next time you hear the term "Deadbeat Dad" or decide to accuse someone of being a "Deadbeat Dad"!

Little or No Incentive for Judges to Follow the Law

Many Judges accused of misconduct or actually found guilty of misconduct or violations of oath of office often times just receive a paid vacation at the expense of the taxpayers!

It's no wonder that many Judges could care a less if they rule according to law, or even worry about making honest legal mistakes.

First the attorneys exchange favors to fix cases in a back room somewhere and then the Judges normally just do what these attorneys tell them to do. Right or wrong, why should the Judges even care? Their basically immune to being held responsible for anything regardless of who is harmed or destroyed in the process.....They have NO ACCOUNTABILITY and can do whatever they want.

What ever happened to these Judges working for us in OUR courtrooms? Now days it's us as taxpayers working for them and their out of control actions and behaviors are what we are paying them for. How many times have you heard a Judge say in court "This is my Courtroom!"????? WRONG JUDGE!!!!, This is OUR Courtroom and YOU are working for us!.

In the meanwhile this is what's happening.....

"Judge, there are several complaints against you, it's time you took a paid vacation to let things cool down, don't worry though, we'll have you back on the bench right after you get back from your cruise and the extended and enjoyable stay in the Bahamas"

Suspensions with pay are nothing less than a paid vacation! The Judicial Commission most often just slaps them on the wrist publicly, laughs at you and I privately, and puts them right back on the bench to continue their "normal" behavior.

In the meanwhile these charades called investigations costs taxpayers hundreds of thousand of dollars only to play out as some silly sit-com on TV.

An arbiter on Friday recommended to the Georgia Supreme Court that Twiggs County Probate Judge Kenneth E. Fowler be suspended with pay following accusations of misusing his judicial authority.

Fowler is accused of asking a probation company to fire two officers who testified against him at a January hearing involving alleged judicial misconduct. The JQC asked the Supreme Court to remove Fowler from the bench.

The court is already contemplating the original case the JQC brought against Fowler in January, which alleges that the judge ran a slush fund in the county, mistreated defendants and engaged in other misconduct, such as telling defendants they had to prove their own innocence. Fowler, who isn’t an attorney, also didn’t apply proper standards for finding guilt and used unqualified people to serve as interpreters, the JQC alleges.

Children live up to what their fathers believe in them; it's a fact of human nature. With more and more fathers being erased out of children's lives, it's no wonder so many children today are out of control and running wild with no guidence!

The government along with their partners in state sponsored terrorism (family courts) have really damaged the fabric of society. Sadly this country is becoming nothing more than a prison state with a large population of orphans.

What we are witnessing in todays society is the beginings of how an empire actually destroys itself from within.

Our childrens children, and their children and so on will look back in history and say "Wow, The United States used to be a great and powerful country!".....and probably be saying it in Chinese, or at least in Spanish.

Former GA Senator Nancy Schaefer found dead!

HABERSHAM COUNTY, Ga. (MyFOX ATLANTA) - The bodies of former state senator Nancy Schaefer and her husband, Bruce were found Friday at their Habersham County home. Both had been shot. The announcement was made around 7:30 p.m. Friday on the floor of the Georgia General Assembly.
Six GBI agents were at the home investigating at the request of the Habersham County Sheriff’s Department.
The preliminary investigation is looking at the case as a murder-suicide, but Georgia Bureau of Investigation spokesperson John Bankhead did not have further details. "Preliminarily, it looks like a murder-suicide," said Bankhead.
Schaefer, 73, was a former Atlanta mayoral candidate, as well as a two-term state senator who represented the 50th District.
Schaefer left the general assembly after losing a north Georgia Republican runoff in 2008. Schaefer founded Family Concerns, Inc. in 1986. The non-profit foundation focused on opposition to abortion and gay marriage and fought for the public display of the Ten Commandments in public buildings. State Rep. Rick Austin announced Schaefer’s death to a packed House chamber Friday night and led lawmakers in a moment of silence.
“Nancy Schaefer was a great lady, and she served Georgia and her constituents with honor and grace,” Austin, a Republican from Demorest, said.

Supreme Court strikes down jail for deadbeat dad

It's about time that someone recognizes this crap as unconstitutional, double jeopardy, and without due process!
Of course this father is automatically called a deadbeat dad too most likely because he has spent several years not having the ability to earn enough income to pay support and survive at the same time.

PIERRE, S.D. (AP) The South Dakota Supreme Court has overturned a lower court's order that required a deadbeat dad to spend ten days in jail every time he failed to pay monthly child support.

The high court says that penalty was unconstitutional because it amounted to criminal punishment imposed without a trial.

The Supreme Court says a circuit judge must re-examine the case to determine the proper penalty for Ed Sazama who was found to owe nearly 63-thousand dollars in past child support for his two children.

The circuit judge could impose a different penalty that is aimed at compelling Sazama to pay the child support. But the Supreme Court says if the judge imposes a penalty similar to the original one Sazama must get the constitutional protections of a criminal trial.

History of Child Support in the US

In the early nineteenth century,the courts in America that were dealing with the cases of divorce and marital breakdowns, found that the current laws don't provide for a support action. America had inherited many English laws in the late eighteenth and early nineteenth centuries, and these laws found that the father had only a non-enforceable moral duty to support his children. In fact, English precedents actually forbid any third party from recovering the costs of support unless these costs had been pre-authorized by a contract with the child’s father.

But England’s laws did allow for a limited recovery of support costs in certain circumstances. The Elizabethan Poor Law of 1601 authorized the local parishes to recover some of the funds that were spent in caring for a single mother and her children who were not provided for by the children’s father.

This statute could only be prevailed upon when the mother and children were completely impoverished. In addition, the Elizabethan Poor Law allowed the town to recoup their relief costs. Any third parties or single mothers could not directly ask for reimbursed of support expenses.

Despite the absence of a child provision within English laws, the courts in American slowly began to tackle the notion that a father had a legal obligation to support his offspring. One of the earliest American support cases was Stanton vs. Willson. The Supreme Court of Connecticut decided this case in 1808. In this case, the Supreme Court of Connecticut allowed Eunice Stanton to recover support from her first husband on behalf of her deceased second husband, Joshua.
It is interesting to note in this case that two of Eunice's children had been awarded to her by a custody decree, and the third had fled from her ex-husband because of fears of abuse. The court clearly stated in this case that the children’s father was legally bound "to protect, educate, and maintain their legitimate children." Similar cases in New York and New Jersey began to assert that a father could be held financially responsible for the welfare of his children.
This financial dependency theme recurred almost in every children support case decided by the courts of America during the nineteenth century, primarily because newly divorced American mothers in nineteenth-century were almost always forced to live in poverty.

Even families that were well off financially before the divorce found that after the divorce, the father almost always profited and the mother almost always became impoverished. This occurred because the men were suddenly free from the expenses of the family, whereas the women were forced to take on the financial burden of raising the children.
In addition, if the mother did attempt to find a job for herself, she generally earned less than what a man would make in the same field.

Once the obligation to financially provide for children was legally established, there were many early children support claims brought about by third parties who had provided board, clothing, or food to impoverished single mothers and their children and who were willing to recover these costs from the non-supporting father.

As the support doctrine continued to develop after the 1850s, the courts began to use a two part "test" to determine the basis for reimbursement. First, the courts asked if the items provided by the plaintiff were necessities that provided for the bare subsistence of the children, such as clothing and food. Second, the courts tried to determine if the father had actually been negligent in providing those items himself.

Before long, the courts in America utilized this child support doctrine to allow newly divorced women to recover directly from their spouse for money they spent in supporting their offspring. As was previously the case, these mothers had to prove the ex-husbands had failed to support their own children.

In addition, divorced women had to show proof that their spouse was at fault for the divorce. Yet, even in these instances, the father was only obligated to pay support for the bare maintenance of the child. But it is important to note that the system that was developing at this time only offered a means of support to caucasian families. Slavery, which was prevalent in both the North and the South, did not allow for the legal marriage of blacks, nor did it allow black men to be considered head of household. These men therefore did not have the rights and duties that made child support relevant.

Under slavery, black children did not have a legal father, therefore there was no way that a black mother could seek compensation from her children’s father. It was not until after the Civil War that black couples were legally allowed to marry. But in many instances, black couples dismissed the formal institute of marriage and instead chose to maintain informal and unofficial marriages.

Child Support Becomes the Law

The laws continued to develop into the twentieth century. In 1950, Congress passed the first Federal child support enforcement legislation requiring State welfare agencies to notify appropriate law enforcement officials when it became necessary to provide aid to dependent children who had been abandoned or deserted by a parent.
Amendments to the Social Security Act in 1965 allowed local and state welfare agencies to obtain information from the Secretary of Health, Education and Welfare regarding the address and place of employment of a non-custodial parent who owed support under a court order for support.

The year 1975 saw big changes not only for the collection of child support, but also for the enforcement of child support collection. Title IV-D of the Social Security Act, was signed into law on January 4, 1975. This law allowed the Secretary of Health and Human Services (previously the Secretary of Health, Education and Welfare,) to establish a separate division, which would be mandated to oversee the operation of a Enforcement program.

This program would establish a parent locator service; state operational guidelines, and a plan for periodic review of cases. The primary responsibility for operating the Enforcement program was placed on each state. These provisions were to come into effect by July 1, 1975.

The next big year for child support laws was 1984, when the Child Support Enforcement Amendments were established requiring major improvements in both state and local Enforcement programs. First, all States were required to develop mandatory income withholding procedures as well as expedited processes for establishing and enforcing support orders (such as income tax refund interceptions and property liens.) In addition, states were allowed to report delinquent parents to consumer credit agencies.

In 1988, The Family Support Act of 1988 was enacted. This act made several important changes to the child support programs. Most significantly, the act required the courts to use State guidelines when establishing support amounts. States were also required to review their guidelines every four years. Another important provision established with the Child Support Recovery Act of 1992, made it a Federal crime to willfully fail to pay past-due child support payments, with respect to a child who resides in another State.

Records show she is a lobbyist for an organization called the National Declaration for Domestic Violence Order.

[Atlanta - A 45-year-old woman, Arelisha Bridges, charged with ending a domestic dispute by killing her 26-year-old husband of five days, is a registered lobbyist for a group fighting domestic violence.

Witnesses told police that Bridges was wearing a nightgown and a shower cap as she argued with Rankins on the sidewalk on North Avenue near West Peachtree Street around 10:45 p.m. Monday.

And moments later, witnesses said, they heard shots. They said she then "calmly walked away."]

House bill would give both parents equal custody of children

NASHVILLE, Tenn. - When parents seek custody of their children, mothers usually receive more rights than fathers, so some Tennessee parents are trying to level the playing field.
Wilky Fain's daughter Addison is 7-years-old now. He said it wasn't until 8 months after she was born that a judge let him see her.
Fain is also president of the group Families Unite, and he made a documentary about his struggle in family court.
"Because of the discretion of a judge," Fain said, "I've never been able to drop my little girl off at school. Because of the discretion of a judge, I've never picked my little girl up at school."
Now, he and other parents are supporting a bill in the state House that would make courts order equal parenting time unless one of those parents is unfit.
This isn't the first time a bill proposing equal custody rights for mothers and fathers will come before the state legislature, but supporters are hoping this is the time that it passes.
David W. Garrett is an attorney who focuses on family law.
Garrett said, "The problem with it is there are many circumstances where it's not in the child's best interest to be with both parents half the time...I think instead of looking at what is best in each case for the children it's going to arbitrarily say 50/50 unless you prove otherwise."
Garrett said according to the experts, children need a stable home, instead of constantly going back and forth.
Fain, who said he still doesn't see his daughter as often as he would like, disagrees.
He said, "It's better to have both parents. Children adapt to their environment...You can burn my house, you can take my car, but why would you take my kids from me?"
A House committee will hear from opponents and supporters of the bill Tuesday.

Georgia County Replaces Sex-Scandaled Politician With Man Who Cheated With Mother-In-Law

Is this a "double standard" or the true meaning of hypocrisy? Or both? What are your thoughts about this ridiculous situation?

Remember, we are talking about Georgia and I haven't looked up GA Code yet to see if having a (within the family extramarital affair) is allowed by law for public officials in Georgia. :)

New Child Support Law - Reading Between the Lines

Once again we have a poor description of words to hide the true meaning of what this "law" is really all about. The quote above mentions "individuals", which means owners of corporations and/or their employees.

The quote above also mentions, "wrongfully modify child support payments", which means owners of corporations and/or their employees who garnish wages less than the child support amount ordered by the court.

The quote above also mentions "hiding behind their corporations" which means that now if an owner of a corporation has any employees that are court ordered to pay child support, the owner of the corporation at any giving moment is subject to a subpoena for financial records and a lawsuit against them. (Invasion of privacy over a civil matter that could result in criminal charges over an employee’s civil debt.) The corporation owner and their employees, specifically accounting and payroll employees are subject to a lawsuit which could result in criminal charges if garnishment records are not in line with child support court orders. Regardless if the discrepancy is intentional or not, the corporation and/or their employees are GUILTY of a crime and may be criminally prosecuted! (Sued, fined, and/or sent to jail).

I mention, "Criminally charged and/or jailed" because as we all know, when a judge rules in a child support case of arrears (civil debt) and that debt is not immediately purged, the debtor will be "criminally incarcerated" for "contempt of court" for a "civil debt". This will now also pertain to corporation owners and/or their employees becoming liable for the debt, not just the parent who owes child support arrears. And we all also know that in these types of family/civil court circumstances, you are always guilty until proven innocent....

Not only have many parents lost their jobs in this recession and are falling behind on child support, now we have new laws coming into play that make it even more difficult for them to find jobs. These types of "laws" will make employers think twice about hiring people who are court ordered to pay child support. Why hire someone who puts them at risk of a costly lawsuit at any given moment?

Not only are millions of good, honest, loving, and fit non-custodial parents now being "snuffed out" of their children's lives, they are now also being "snuffed out" of the work force (their ability to earn income). This eventually leads to being "snuffed out" of society...all due to the fact that most often involves a ridiculously high child support court order to begin with, or a change of job with lower pay, or becoming unemployed due to reasons beyond their control.

Man Forced to pay Child Support when proven not to be the Father

State Rep. Tim Solobay, D-Washington County, wants to change state law due to that the "Paternity Law" was written after the old law of "presumed fatherhood". He has introduced a Bill and already Supreme Court Justice Max Baer is saying the legislature shouldn't be rushed into new legislation......dah, sounds like Justice Max Baer may be a little bit concerned about federal funding to his state through Title IV-D more than the extortion tactics that are destroying good men in HIS STATE.

But the story has a twist, this man (the cheated on and lied to presumed father) has an emotional bond with the little girl he doesn't want to see broken.

How do you protect that relationship and protect the child who has long believed Mike to be her real father?

Legal system stacked against dads, Utica attorney says

Facing the loss of his law license, local attorney Leon Koziol on Monday compared his failure to pay child support for the last two years to the acts of civil disobedience carried out by Rosa Parks and other civil rights leaders in American history.

At a press conference conducted at his home here, the fathers' rights advocate restated his belief that custody proceedings are biased against dads.

The state Supreme Court's Appellate Division suspended Koziol's law license last week based on his failure to make child support payments for his two daughters - ages 6 and 8 - since November 2007.

But Koziol said he plans to appeal that ruling. And he hopes doing so will bring more attention to what he calls an "antiquated" and "inherently flawed" custody system.

"Susan B. Anthony. Martin Luther King Jr. The people who went to the front of the bus. What did they do? They violated the law, and it sent a great message," Koziol said.

Koziol and his ex-wife, Kelly Hawse-Koziol of New Hartford, filed for divorce in September 2005 and have been involved in a battle over custody and visitation ever since.

Accompanied by his girlfriend and by fellow National League of Fathers leader John Kalil, Koziol displayed photographs of him and his daughters spending time together. He said he has not been able to see the girls since July due to various court orders.

But Rebecca Crance, the attorney who represents Koziol's ex-wife, challenged Koziol's description of the visitation arrangement.

She said Koziol has been awarded parenting time but "has refused to accept it." And she said she was not aware of an incident Koziol described in which his children were not home last fall when he went for his scheduled visitation.

"My client feels the Appellate Division made the appropriate decision regarding the child support," Crance said. "My client would prefer that these very private matters would stay out of the media, but Mr. Koziol has made that impossible."

Koziol said he made his personal story public only after his related license suspension became front-page news last week.

He has been more public, however, with his views on custody issues in general.

As legal adviser for the National League of Fathers, he frequently speaks about how the current system turns fathers into "visitors" in their own families. He said he is an advocate for "shared parenting" - an arrangement in which both parents have equal or near-equal time with their children.

On Monday, he described child support as a "multi-billion-dollar industry," and said that federal funding tied to its collection gives states an incentive to perpetuate the system. Lawyers and civil servants who work within the court system also benefit from the current framework, he said.

Koziol also said that he remains more concerned with fighting for time with his children than with the status of his license.

"The bond, the parent-child relationship between a father and his daughter, is much stronger than a law license, a career or anything else in life," he said.

Another attorney from Koziol's firm will take over his existing cases until such time as he is again able to practice. he said.

Koziol's clients include former Pistol Pete's owner Stephen Patterson and gunshot victim Casey Stuckman, who accuses Utica police of injuring him.

American Recovery and Reinvestment Act (ARRA) Impact on Child Support Incentives

BACKGROUND:

A Federal match of 66 percent is available for State administrative costs of carrying out child support enforcement program activities under title IV-D of the Social Security Act (Act). ARRA temporarily changes the child support authorization language to allow States to use Federal incentive payments provided to States in accordance with Section 458 of the Act as their State share of expenditures eligible for Federal match. This change is effective October 1, 2008 through September 30, 2010. The requirements of Section 458(f) of the Social Security Act and 45 CFR 305.35 regarding "reinvestment" of incentive funds remain in effect.

This change is in effect for any incentive funds expended during FY 2009 and FY 2010, including incentives earned and not expended in prior years (i.e., prior to October 1, 2008). Incentive payments expended during FY 2008 (October 1, 2007-September 30, 2008) are not eligible for additional Federal funds.

REPORTING REQUIREMENTS/ACTION REQUIRED:

Each State submits Form OCSE-396A, the "Child Support Enforcement Program Expenditure Report" within 30 days of the end of each fiscal quarter. Line 1a, "IV-D Administrative Expenditures Made Using Funds Received as Incentive Payments." will be revised. All reports and revisions must be submitted in the normal manner electronically through the On Line Data Collection (OLDC) system unless the State elects to submit paper copies to the appropriate Regional Office.

FY 2009, 1^{st Quarter Expenditures} - For any State that has submitted Form OCSE-396A with 1st quarter expenditures reported on Line 1a, OCSE will compute the Federal share as 66 percent of the amount reported in Column A (Total) of that line and issue an award in that amount to the State.

FY 2009, 2 and 3 Quarter Estimates

- States should review expenditure plans and may submit revised reports, including an estimate of 2 (second) or 3 (third) quarter expenditures on Line 1a (Col E). Revised estimates for second quarter will be processed and awarded promptly as they are received. Grant awards for third quarter estimates will be issued no earlier than April 1, 2009.
ADDITIONAL INFORMATION:

States should take care to anticipate accountability and transparency requirements and that information on state-reported impact of these expenditures will be available to the public. Interesting child custody case in Bibb Co., Georgia

Bibb mother to represent herself before state Supreme Court
Father got custody in 2002, and Mother has been trying to get custody of child since she was forced to pay child support in 2006. She now claims domestic violence and over crowded living conditions are reason for change of custody.....and that the father committed perjury and slandered her at the original custody trial. Hmmmm????

A Bibb County mother is scheduled to represent herself today before the Georgia Supreme Court in hopes of gaining custody of her 10-year-old daughter.

The child’s mother, Nevis Jones, and the father, Lypell Foster, divorced in 2002. Foster was awarded custody of the girl by the court system, according to a case summary prepared by the Georgia Supreme Court’s news office.

The order gave Jones the right to have supervised visits, but the courts didn’t require her to pay child support because of health problems. In 2006, Foster sought child support, and Jones was ordered to pay until the decision was later terminated because of her health, according to the summary.

In April 2006, Jones filed a motion alleging that Foster violated the divorce decree by seeking child support and sought a change in custody. She cited overcrowded living conditions and an alleged history of family violence as reasons for the needed custody change, according to the summary.

After a hearing, the trial court ruled that Foster had not violated the divorce decree because it didn’t prevent him from seeking child support in the future. The court also denied the mother’s motion for a change in custody because she failed to show that the change was in the best interest of the child, according to the summary.

Jones filed an appeal with the Georgia Court of Appeals, but the case was transferred to the state Supreme Court.

Jones argues the trial court made a mistake in denying her 2006 motion because she alleges Foster committed perjury and slandered her to obtain custody.

She also argues that the girl is living in overcrowded conditions and slept in the same bed with her father until she was 7, according to the summary.

Foster has not responded to Jones’ appeal.

Another County Clerk caught stealing IV-D federal child support incentive funding!

Update on federal investigation surrounding former clerk of court expected this week

Fourteenth Circuit Solicitor Duffie Stone expects to meet this week with federal investigators to get an update on their inquiry into former Beaufort County Clerk of Court Elizabeth Smith's use of federal child support funds.

Stone said he is meeting with investigators with the U.S. Department of Health and Human Services on their investigation into accusations Smith funneled "IV-D" money to the Beaufort County Drug Court, a program run by her husband, Manning Smith. The federal money, which is disbursed to the clerk's office through the state Department of Social Services, is supposed to be used for child support enforcement. The amount Smith diverted to the program has not been disclosed.

Smith's use of the child support funds was what sparked the S.C. Ethics Commission Investigation into her use of public funds, an inquiry that resulted in her being charged by the state on July 30 with multiple counts of embezzlement and misconduct in office.

Scott McElveen was paid $50,000 to complete the audit shortly after Smith was indicted for writing checks worth $23,500 from clerk's office accounts to pay for insurance premiums and a vacation home on Pawleys Island.

Koziol's law license suspended

At issue: failure to make child-support payments

New York Attorney (Utica) who has promoted fathers rights in recent years, Leon Koziol, has had his law license suspended indefinitely due to that he hasn't paid child support and his claims that it is "unconstitutional".

"A state-created "custodial parent" is "awarded" with
formula-driven welfare payments that have no child-based accountability,"Koziol wrote. "The payor, typically a male parent, is marginalized to 'visitor' status and suppressed as a 'non-custodial' creature of 'law' in order to maintain a regular flow of money payments."
This is a perfect example of what happens when a member of the brotherhood doesn't agree with the "status quo" and takes a stand against it, they are eliminated.
Although I do not agree with his methodology of completely financially neglecting your children, I do agree with his claims that the child support system violates the constitutional rights of many on a daily basis.
There are more ways to support your children other than just sending a check every week. Children need both parents physical and emotional support too. In many cases, if not all cases, this is more important than just financial support alone. Just take a glance at our society and most of the "problem children" in it come from single parent homes where one parent has been reduced to a 4 day a month visitor, or eliminated completely.
Currently our system is set up to order the elimination of the physical and emotional support of one parent, most often the father, to establish a financial support order called "Child Support" from the physical and emotional separated parent. Way too often this "quarantined" parent's absence causes severe identity and psychological problems for the children that lasts a lifetime. It's State sponsored Parental Alienation and Child Abuse to collect federal incentive funding in my opinion.
When two parents are fit, willing, and capable, 50/50 financial, physical, and emotional support of the children should be a given and "status quo". As I have said before, if federal incentive funding supported keeping children and families together rather than breaking families apart, we would not be seeing these types of cases very often.

Man accused of fathering a child at 7 years old, State demands him to pay Child Support!

National Guardsmen Rusty Cole is obviously a man who is a victim of mistaken identity, yet the State doesn't care. All Florida can say about it is that he is listed as the father and he must PAY PAY PAY! Florida considers him just another "deadbeat dad" who is trying to get out of paying child support!

The Catch? Rusty was born in 1987 and the child he supposively fathered was born in 1995, by a woman he doesn't even know, nor has ever met! That would make him probably the youngest human to father a child in history. Needless to say this has cost him thousands of dollars and now has finally involved Florida Governor Charlie Crist to intervene.

“My dad had a stroke a few years back,” Cole said. “He hasn’t been able to
go to work. He’s disabled. My mom’s been paying all the bills here.”

For weeks, Cole e-mailed, made phone calls and even went to the state
agency in person to protest, but he said he was told a child born in 1995 was
due money, and Cole needed to pay.

“They were like, ‘Oh, yes, we have it on here that you are the father,’
and I was like, ‘Ma’am, there’s no way,’” Cole told News 13.

So far Cole has only recieved a brief apology from the Dept. of Revenue.

“I want this completely off my record,” Cole said. “I don’t want this ever
affecting me later on in life.”

Hopefully Rusty Cole, with the help of Governor Crist will get this matter resolved quickly so this young man isn't destroyed by the heartless and corrupt Child Support system of Florida. It's one thing being destroyed by the Divorce and Children Support System when you have actually fathered children, but it's another thing when they are setting their sights on fathers "who may have fathered children", even to the extent of a 7 year old boy fathering a child!!!!

District Court Judge Cheryl Moss forces Father to go to the Nevada Supreme Court in his efforts to modify child support! Judge should be charged with contempt, conspiracy to extortion, and child endangerment/abuse etc.!!!! This is an obvious abuse of power to intentionally hurt and harm a father/child relationship and violation of several constitutional rights and due process!

“The child’s best interest is not served by perpetuating a support order
that the obligor parent’s changed circumstances may make unreasonable,’’ Nevada Justice Kristina Pickering said.
This Father is being forced to pay over $6500.00 monthy in Child Support, more than $3500.00 than what he earns! Father, Anthony Fernandez, has been trying to modify Child Support since 2007!

"A man who once earned between $500,000 and $4 million a year in the stock
market should have a chance to get his child support payments reduced now that
the economy has soured and his earnings have declined," a court has ruled. But
when the stock market tanked, Fernandez ended up earning $3,000 a month selling cars.
District Court Judge Cheryl Moss denied the petition of the father to
modify the support payments. His ex-wife’s financial condition has improved with
her gross monthly income either equaling or outmatching his, Fernandez
argues.
With hundreds of thousands of gov't jobs relying on Title IV-D incentive funding, this case really doesn't surprise much as I hear about this type of situation happening daily, mostly with fathers. Judges are basically protecting their pensions and "BONUSES", giving job security to many in the brotherhood that rely on Title IV funding as income, just by denying Child Support Modifications.

This system is set up to financially secure the few by the destruction of many, specifically by destroying families and children. If the incentive to destroy families and children for financial gain was removed, cases like this one would be rare. The Divorce and Family Court Industry needs to be drastically reformed immediately!

To Whom it may concern,

The UN has closed a major gap in disability rights protection. 6 June 2008- the recent entry
into force of the United Nations Convention on the Rights of Persons with Disabilities
closes a major gap in human rights protection for hundreds of millions of people around the
world. I am Ricardo Rivero and I suffer from a crippling learning disability referred to as
Dyslexia.

The story definitively begins with the birth of my son Ricardo Adrian Rivero on April 16,
1990 one of the happiest days of my life and sadly the beginning to an all out war of the
roses. When he was born I soon found out that my relationship with Sheila Leal had been
infected with the disease of infidelity that plagues our American Culture. Of course you
know how quickly our emotions and insecurities arose during this torrential war and ended up
in a separation. We parted paths and soon she found herself in another relationship that
ended in the death of her new spouse by a heroin drug overdose. What a perfect role model
for our child. During this time I found myself on the wrong side of the law and was
incarcerated in a Federal Prison. Shortly before her new husbands untimely demise we entered
into the Court system in Montana which it was decided by the court that the central
depository would deduct child support from my paychecks.

In December 2001 Sheila and I decided to reconcile our differences and attempt to live
together for the common goal in this trivial pursuit of happiness to re establish our
family. I continued to pay child support even though we lived together as documented by my
Federal Probation Officer who informed me that it was a violation of probation not to pay
child support. I discussed the issue with my probation officer who suggested that Sheila
would need to cancel the child support since we had continued to live together to avoid any
penalties. In October 2, 2002 we were sent a notice stating that child support obligations
were cancelled.

One year later we again separated and I moved back to Homestead. I received a letter from
the Department of Revenue (D.O.R.) in Sarasota stating that I owed $15,000 in child support
arrearages. Unfortunately I could not get the courts to even glance at the evidence that I
presented in my behalf that would ultimately sway the case in my favor. The Family court
system that we now have in place favors the woman and makes it a crime to be a Father who
merely wants to be involved in the life of our child. Even though the tender years Doctrine
has been abolished in the late 80’s, which briefly states that a child would be better,
suited to live with the mother than the father.

Countless letters and documents were produced to the D.O.R. and the Judges presiding over
the case and the expert testimony of my federal probation officer was quickly denied not
once but twice, as my due process rights and my constitutional rights were thrown out of
court. Time after time David G. Taylor a private Attorney who represented Sheila Leal and
his client committed perjury with the intent to commit fraud against the court to gain
equitable relief and to gain an unfair advantage. I represented myself as a pro se litigant
as I was unable to swallow the expense of an Attorney at that time. I attempted to seek the
assistance of the Florida bar that approved me with a pro bono Attorney. My request was
denied by David Taylor and the Judge Dianne Moreland who stated that with a 6th grade
education disabled or not I could have adequately defended myself. This again is a denial of
my rights, which I am covered by the Americans with Disabilities Act.

Ultimately David G. Taylor seeking to destroy my credibility in court set a hearing date and
did not adequately advise me through proper notification of the time and date or the
presiding judge and the details of the hearing. Complaints coincidentally have been filed
with the Florida Bar against David G. Taylor. I did not attend the hearing for lack of
knowledge that it was to be held which the judge attached a writ of bodily attachment of
$2,800. The officers seeking to place me into custody were sent to my address by Sheila and
I was arrested on a bench warrant. After nine days I paid the purge and was released.

Three weeks later I was arrested again during a routine traffic stop in which the officers
informed me that the arrest warrant still stood and was not removed. I was held for five
more days in a Dade County Correctional Facility. The guard awoke me from my sleep by
kicking my bed and stated that we have nothing to do with this you now have what we call and
consider a double jeopardy and I should pack my bags and leave Dade Counties illustrious
criminal vacation facility. Sarasota received the money and had not removed the warrant that
had already been appeased in my first arrest. I was not asked to bond out simply released
due to an error. I was fired from my job and forced to move out of my home as I was living
check to check with no job and out on the streets because someone forgot to process the
paperwork that sat on some pencil pushers desk. I have now begun to file a 100 million
dollar lawsuit for double jeopardy against Sarasota County.

The image of blind justice with the woman holding the scales haunts my daily walk for it is
the woman who holds the scales. How ironic that a person who see’s that image and reads the
quote “All who Labor here seek justice” does not look at it as a woman who holds the scales.

Four income tax checks, my passport, and my license has been seized on the basis that I have
not paid my child support that I can prove I do not owe homeless and forced to live with a
family member on the sofa with my son. Yes my son who has run away from home to live with me since he was 16 and we now celebrate his 18 birthday just this past April 16. The
celebration is now that he is sur juris citing a landmark case of Crone Baugh v. Van Dyke.
415 So 2d 738 (Fla. 5th DCA 1982, Rev. denied, 426 So. 2d 25 (Fla. 1983) the cause of action
to enforce the father’s child support obligations, [if any] and to collect those arrearages
belonged to the children, and that their mother as such, did not have standing to enforce
the children’s rights and to collect from the father the money due the children, neither did
HRS have the right or standing to collect those sums on behalf of the former wife.”

He alone has the right to enforce or withdraw the course of action of enforcement of child
support and arrears. He is fed up with his mother’s actions and parental alienation of his
father. He is a witness first hand to the plots against his father and the atrocities of the
situation countless perjury attempts and vindictive maliciousness to utilize the system to
gain an unfair advantage. He should have been protected from all pending court matters and
disparaging remarks (as stated by chapter 61) made by his own mother that has damaged him
psychologically. Parents fail to realize that when you attack the other parent you stab at
the child as well for that child understands that he is a part of the other parent who is
being attacked.

In a land where African Americans sought and obtained equal rights, Women burned their
braziers and protested for equality, Gays and Lesbians actively seek the opportunity to
establish their relationships and be bonded in Matrimony. How can I as the Paternal Father
of my child have my equal rights to seek justice in a fair and impartial court system in
Sarasota County?

Philpot delivered a check for $29,948.07 to the county Thursday after receiving word from County Commissioners' attorney John S. Dull that Philpot needed County Council approval to use money from an "incentive fund" for child support collections to boost his pay.

Attorney Silences Tammi Smith, the search for “Baby Gabriel” continues

HAHA! Yeah Right! This woman will not be able to keep her mouth shut. Vindictive and manipulative people (narcissists) have a hard time following instructions from "low life insects" that are otherwise known to an average person as "fellow human beings". She won't be able to control herself and will be facebooking and talking away as she deems fit. Through her actions already she is obviously addicted to being center stage and under the spotlight! Which is another well-known trait of a classic narcissist.

Many of us in the family/parental rights arena have been watching this story and see many similarities to the actions and circumstances of those involved in this case that relate to issues many of us deal with on a daily basis. Mainly, custodial interference/manipulation of parental rights to their children. More importantly, a child's right to their fit and loving parent! The Smith's seem to be a perfect example of the third party interferer such as the family courts, their agencies, and attorneys, and the mother as the classic vindictive alienator, who obviously has gone way over the edge.

What many haven’t realized is that there is another situation that may have been manipulated by the Smiths involving another child and possible kidnapping and/or "forged" adoption. Travis Warford, ex son in law of Jack Smith claims/alleges that he was stripped of his parental rights to his daughter involving possibly the same adoption specialist involved in the Baby Gabriel case, Janet Morris. Grandfather Jack Smith now has custody through a possible abduction and "forged" and/or manipulated illegal adoption of Mr. Warfords daughter. If this is true, the Smith's may well be in deeper than they realize in illegal activity, or maybe they just believe they are above the law. Their actions in both of these cases make them highly suspicious of being not just concerned citizens as they claim to be. It is my personal opinion that the Smith's are very quickly proving themselves criminal and/or UNFIT TO PARENT!!!!! Tammi Smith has already lost custody of three of her own children and many wonder what the circumstances behind that "child custody issue" were.

Through several local and national interviews, the Smiths have already stuck their feet in their mouths too many times and have incriminated themselves to at least being involved in custodial interference and forgery concerning the baby Gabriel case. Why Jack Smith has not been arrested for his involvement in this matter is beyond me, maybe they are still gathering evidence on him? Also, will Janet Morris find herself behind bars soon too?

Although "The Smith's" have seemingly made themselves the center stage celebrities and thrive to grab most of the attention in the baby Gabriel case, the real issue right now is about finding this little boy "Gabriel" and returning him to his father and his family. Father of Gabriel, Logan McQueary and many others are doing everything they can right now to find his little boy and due to many obstacles, mainly two, "The Smiths and the mother Elizabeth Johnson" the task has proven to be very difficult to say the least.

Is this what you call "Not practicing what you teach or preach?" This man is actually lucky that he wasn't shot dead considering he pulled a gun on two two depupty US Marshalls!

A respected domestic violence and anger management counselor in Fairfax County was arraigned in federal court Thursday after he allegedly pulled a gun on two men who he believed were blocking his car on an Annandale street last week.

The two men were federal marshals.

Jose L. Avila, 57, was ordered held without bond pending a detention hearing Friday in U.S. District Court in Alexandria. He has been held in the Fairfax jail since Jan. 25, when he apparently picked the wrong place and time to complain about thoughtless parking.

My Basic Thoughts About Parental Alienation

I have said on several occasions that Parental Alienation is nothing less than an act of terrorism. All one needs to do is grab a dictionary and look up terrorism, terror, terrorist and all logic and common sense is plain and obvious to see what this abusive and pathetic behavior really is. I also see it as a form of kidnapping and also physical, emotional, and psychological abuse. Plainly and in simpler terms, Parental Alienation is Child Abuse and a Hate Crime at many levels.

Then you have a group of idiots out there that claim Parental Alienation doesn't exist, that it is a myth and strategy used by abusive fathers only to gain an edge in child custody battles in order to get custody. I'm sure some pathetic fathers may actually do this, but to claim Parental Alienation does not exist? Well, that is completely ridiculous!

One has to wonder why Parental Alienation hasn't been recognized in this country (and others) as an actual crime, punishable by severe penalties. Personally my theory is that if Parental Alienation was actually penned into code books as an actual crime, misdemeanor or felony, millions of dollars would be lost in the evil controllers pockets that run the Divorce and Children Industry.

So therefore, it is my opinion that not only the alienating parent, but also the evil controllers of the Divorce and Child Industry, their agencies and officials, are guilty of conspiracy, accessory, committing acts of terror, child abuse, hate crimes, and extortion, regardless if Parental Alienation is actually penned into our code/law books or not.

Shares of this company dropped from $63.48 to $62.96 yesterday, I guess they better call upon the FED to see if they can get some bail out money!!!! ]

UTAH-House clarifies requirements for biological fathers

The Utah House voted Tuesday to codify a Utah Supreme Court ruling that requires biological fathers to assert their rights in court before an adoption if they wish to raise the child themselves.

Representatives approved HB74 by a vote of 54-18. It's a response to a court battle in which a biological father attempted to gain parental rights outside of the state but did not follow Utah's procedures. Rep. Lorie Fowlke, R-Orem, who voted for the bill, said she wanted her colleagues to be clear that it restricts a father's rights.

"Utah already has one of the strictest adoption laws in the country and gives the least amount of rights to fathers," Fowlke said. "This is another step in that direction."

The bill adopts in law the Supreme Court's unanimous ruling that a biological father out of state who knows that the mother is in Utah must file for his rights in Utah's legal system, said Rep. Sheryl Allen, R-Bountiful, the bill's sponsor.

"Adoption is important in Utah," Allen said, adding the bill helps facilitate it.

Amid the media frenzy over Tiger Woods and Bengals receiver Chris Henry, a key aspect of both stories slipped through the cracks: Like millions of other men, Woods and Henry were -- allegedly at least -- the victims of domestic violence perpetrated by their wives or girlfriends. Beyond its brutal physical and psychological costs, domestic violence against men exacts a cruel economic toll at the personal, societal and national levels.

For the most part, the media, authorities and average citizens see domestic violence as a crime that is committed by men and victimizes women. Consequently, funding to combat the problem has overwhelmingly been spent on programs that support women.

Once again a poor title for a story! Missing after road trip? yeah right! MISSING AFTER BEING KIDNAPPED is more appropriate!

[The car belonging to Elizabeth Johnson, an Arizona mother who allegedly told her ex-boyfriend she'd killed their 8-month-old son, was found Tuesday in Texas, an FBI spokesman said.

Johnson was arrested last week in Miami Beach, Fla., on suspicion of custodial interference after she failed to show up for a custodial hearing in Phoenix. Authorities say she refuses to say where her son is.]

Another vindictive and psychotic mother that will do anything to prevent a child to have a relationship with the father? Even to the extent of murder? We'll see....Mother told the father in a text message that he would never see his baby again because she killed the child.

Nancy Grace reported on her show last night that this mother has two recent police reports claiming in a fit of rage she did property damage in her home and charged not with domestic violence, but "criminal damage". Nancy also reported that CPS was investigating the welfare of the child, and that the mother had lost custody of Baby Gabriel after failing to appear at a Dec. 28 court hearing.

Seems we have recently seen many cases where mothers are becoming more violent and vindictive towards fathers with their children, or at least the media is just now starting to broadcast more about these types of custody and criminal cases.

Sadly, things do not look very positive for this little child right now. Let's hope this little baby is returned safely to the father!

Travis Warford, biological father of Jack Smiths granddaughter Hannah claims grandfather Jack Smith stripped him of his parental rights without notifying him or his family and adopted his daughter. Travis claims he has been completely alienated from his biological daughter! Travis states, " The Smiths falsified information stating they had in order to gain custody and have manipulated the system to adopt my little girl without contacting me or my family."

During the Baby Gabriel investigation, FBI searched the house of adoption specialists in Nashville, Janet Morris, and uncovered documents where Morris was challenged for allegedly stripping a father of his parental rights without properly notifying him. [Reported by CBS5 news Phoenix]

Travis also states that he is afraid of Jack Smith due to being threatened by him and that Jack Smith also once tried to bribe him with $5,000.00 to pay for his divorce with the terms "that Travis would immediately leave town".

Travis also claims that he was jailed more than once for several bogus and fabricated "trumped up" charges.

Travis found out his daughter was adopted by the Smiths through a search for Tammi Smith's MySpace page where Tammi Smith posted pictures and wrote of her newly adopted child, "Hannah".

CBS5 news of Phoenix also reports that [Tammi Smith said her former husband abused her and after several years of fighting, she lost custody of her three daughters] Why did she lose custody of her three daughters if she was the one being abused for several years? Someone is not telling the truth and now the Smiths are saying Travis Warford is completely lying about what they have done to he and his daughter. The documents recently uncovered by the FBI clearly show Jack Smith's "adoption specialist" was challenged for stripping Travis of his parental rights, now who is lying? Travis was stripped of his parental rights and inhumanely alienated from his daughter!!!! What is even worse is that this little girl was stripped of HER RIGHTS to her loving, caring, biological father!!!!

Now there are two little children that we know of connected to the Smiths that are completely separated from their biological fathers. Logan McQueary, father of baby Gabriel was possibly going to be another victim of the Smiths and have his parental rights stripped from him and things went totally wrong and lets hope that Elizabeth Johnson is hiding Gabriel alive somewhere and with someone safe and that he will be found. The father Logan and his family need his son returned safely to them immediately!

Travis Warford also has a child missing from him and his family and fortunately he knows the location of his daughter. There needs to be an investigation into the Smiths seemly shady actions and behavior and Travis's daughters’ adoption. A young little girl needs her father!

Congress blames fathers for the child support problem in this country, by calling them "deadbeat dads" (even though it has been proven through studies and statistical analysis that less than 5% are true deadbeats) rather than admit its own dubious contribution to the suffering of America 's children. Politicians promulgate the myth that they are helping children through federal and state welfare entitlement programs. It is, in fact, these very programs which are responsible for the out of control rampage against children. Here is how the scam works.

The federal government levies taxes against citizens to redistribute as welfare entitlements among needy applicants. Congress created the Social Security Act, a section of which is called Title IV. Title IV describes how tax dollars will be distributed among the States to subsidize their individual welfare programs. In order for States to tap into the federal treasure chest, containing billions of dollars, they must demonstrate that they are complying with Title IV mandates to collect child support revenues. In other words, to get money from the federal government, each State must become a child support collection and reporting agency.

Every unwed or single mother seeking welfare assistance must disclose on her application the identities of the fathers of her children and how much child support the fathers have been ordered by a family court to pay. She must also commit to continuously reporting the father's payments so that the State can count the money as "collected" to the federal government's Office of Child Support Enforcement. As with all bureaucracies, this process has developed into a monstrosity that chews up and spits out the very people it was designed to help.

States have huge financial incentives to increase the amount of child support it can report to the federal government as "collected".

To increase collection efforts, States engage in the immoral practice of dividing children from their fathers in family courts.

Have you ever wondered why family courts award custody to mothers in 80%-90% of all custody cases, even when the father is determined to be just as suitable a parent?

It is because the amount of child support ordered by the State is largely determined by how much time the child spends with each parent.

This means that the State "collects" less child support if parents share equal custody.

By prohibiting fathers from having equal custody and time with their children, the State's child support coffers are increased and federal dollars are received.

Opponents try to paint loving fathers as "deadbeat dads" for daring to challenge the mother-take-all system of family law. This is nothing more than diversionary propaganda. The concern of fathers is not that they are unwilling to support their children financially. This is not an argument against paying child support. Any father that cares about his child will do everything in his power to provide for the child. The concern is, rather, that children are being separated from their fathers by family courts because the State stands to reap huge financial rewards as a result of the father's loss of custody. The higher the order of child support, the more money the State can collect - even if the amount ordered by the court far exceeds the reasonable needs of the child or if the father is required to take second and third jobs to keep up with outrageous support orders and escape certain incarceration. The truth is that most fathers don't care about the financial aspects of these family court verdicts nearly as much as they care about having their time with their children eliminated for nefarious government purposes.

The root of this evil is a State-level addiction to federal tax dollars being doled out as entitlement monies by a monolithic federal government. In the wake of this horror are millions of children drowning for lack of the care, guidance, and companionship of their fathers. Statistics and empirical evidence universally confirm that children forcibly separated from their fathers by family courts are considerably more likely to suffer anxiety and depression, develop drug addiction, engage in risky sexual activity, break the law, and commit suicide. This travesty must end.

Unconstitutional federal bureaucracy creates many of the societal ills it claims to be trying to solve. There are several steps incremental steps that could be taken to restore a child's right to the companionship of both parents. For example, citizens should insist that States abide by the 14th Amendment to the Constitution. No father should be automatically deprived of his fundamental right to the custody of his children without due process of law. Being a male is not a crime. Absent a finding of true danger from a parent, family courts should order shared parenting rights and equal time sharing for divorcing parents. These rights are fundamental and should not be abridged. The automatic presumption of custody-to-the-mother is unconstitutional.

The history of America is brim with examples of the federal government denying basic rights to its citizens. Women were denied the right to vote until the women's suffrage movement secured the 19th Amendment to the Constitution. Black Americans also were denied the right to vote and suffered myriad other cruel and humiliating indignities under the law until the civil rights movement brought about desegregation, put an end to Jim Crow legislation and compelled the enactment of the 15th and 24th Amendments to the Constitution. In each of these examples, society was slow to recognize that a problem even existed or that some of our laws were unjust. It took considerable time, concerted effort, self-sacrifice and perhaps even divine providence to realign concurrent societal paradigms with the principles of liberty and justice for all.

Our generation is not exempt from similar assaults on liberty. While many just causes may stake claims for redress of grievances, one group, more than any other, pleads for immediate support. The need to defend the rights of this group of American citizens, reeling from the unjust consequences of state-sponsored oppression, is before us. It is time to stand up for the rights of FATHERS and children.

- The Louisiana Department of Social Services (DSS) set a record for the second year in a row when it comes to collecting child support payments -- more than $354 million for Federal Fiscal Year (FFY) 2009, which is up from more than $346 million collected in FFY 2008.

DSS recently was awarded a record $6,796,529 in performance incentive funds by the federal Office of Child Support Enforcement as a result of the agency's performance in FFY 2008. DSS' award amount has more than doubled since the award system began in 2000.

CROWN POINT -- In his last year as Lake County clerk, Thomas Philpot saw some of his biggest paychecks.

Philpot made $83,473 in 2009 as clerk -- a total that included $14,000 in "supplemental pay" in a year when countywide budget cuts trimmed four full-time positions from the clerk's office and $423,000 from its budget. From 2004 to 2008, his pay has ranged from $67,000 to $70,000.

"It's by statute, it's approved. Nobody's stealing. It's a nonstory," said Philpot this week. "I didn't do anything no different than the clerk before me and before that."

County records show Philpot received $9,000 from the fund on his paychecks in January and $5,000 in October 2009.
"I never noticed it, I just give the checks over to my wife," Philpot said.

OSKALOOSA — A former Oskaloosa man has been sentenced to prison after he pled guilty for failure to pay child support.

Charles Anthony Penn, 42, of Charlotte, N.C., and formerly of Oskaloosa, was sentenced by U.S. District Court Judge James E. Gritzner to 10 months in federal prison on the failure to pay child support charge.

Penn was also ordered to serve one year of supervised release after completion of his imprisonment, pay an assessment of $100 to the Crime Victim Fund, and restitution of more than $91,500.

Penn had been ordered to pay child support and back child support by the Iowa District Court for Mahaska County in 2006 and failed to pay as directed by the court. The case was referred to the federal government after Penn left the state of Iowa, and enforcement was sought by the Iowa Child Support Recovery Unit, a division of the Iowa Department of Human Services.

Penn was indicted by a federal grand jury in December 2008 and pled guilty to the charge last July.

The benefits of the government forcing men to pay child support

Forcing men to pay child support does NOT benefit the child... it benefits the political view that family law is PROfamily... this view exists to disguise the more obvious agenda. The government has found a way to take something as sacred and wonderful as raising a child, and turn it into another profitable industry.

According to Title IV-D, state child support collection agencies recieve a huge financial bonus for the child support arrears they collect. Therefore, it is child support arrears that are a good thing. By focusing on the few mothers who have conceived a child with a REAL deadbeat (meaning a man who willingly avoids all responsibility of his child) they are able to "sell the idea" that any man who does not pay child support is now (gasp) a deadbeat. And thus, it is socially and politically acceptable to impose an authoritarian strategy over noncustodial parents. Pay, or else.

A child becomes a burden when you are missing 20% of your paycheck every week. Child support is not based on the needs of a child, it is based on income. One child is worth only $20 a month while another is worth $2000 a month? How can somebody who earns less than $20k a year have debt that is greater than $2000 a year for his child? The answer is obvious, and yet so many fail to acknowledge it. When you ask your ex to "support" your child by taking him to court and placing a child support order on him, you have just used your child as bait... not only for your own profit but also for the profit of the goverment.

If a man gives a woman money for diapers, food, or to help with rent or another bill when she needs help supporting a child, this is legally considered a "gift." If a judge orders a man to pay 50% of child related expenses, such as day care, this is considered an "add on" and is additional to that standard 20% of your income.

In summary, forcing a man to pay child support is beneficial to the government because it brings in more money. By enforcing an amount that nobody can afford to keep up with, a man will be placed in arrears and here is where the profit lies for the government. There is a social lie about "deadbeat dads" that has been bought into for far too long. Does it really seem realistic to you that nationwide, there are millions of fathers who don't want to help raise their child? Does it really seem possible that enforcing a financial burden is actually pro family, and not just self serving?

Why else would politicians brag about collecting billions of dollars in child support arrears by intercepting UNEMPLOYMENT BENEFITS?

THE VICIOUS CHILD SUPPORT "BRADLEY AMENDMENT"

In United States law, the Bradley Amendment is the common name given to any of a number of amendments offered by Senator Bill Bradley, the most notable of which is the amendment to 42 U.S.C. § 666(a)(9)(c) which requires state courts to prohibit retroactive reduction of child support obligations.

The Amendment was passed in 1986 to automatically trigger a non expiring lien whenever child support becomes past-due.

The Law overrides any state's statue of limitations

The law disallows any judicial discretion, even from bankruptcy judges.

The law requires that the payment amounts be maintained without regard for the physical capability of the person owing child support (the obligor) to make the notification or regard for their awareness of the need to make the notification.

The Amendment has been a controversial law and has resulted in several notorious examples of unintended consequences including:

A veteran of the first Gulf War who was captured in Kuwait in 1990 and spent nearly five months as an Iraqi hostage being arrested the night after his release for not paying child support while he was a hostage.

A Texas man wrongly accused in 1980 of murder. After 10 years in prison, the man sued the state for wrongful imprisonment. The state responded with a bill for nearly $50,000 in child support that had not been paid while in prison.

A Virginia man required to pay retroactive child support even though DNA tests proved that he could not have been the father.

.......a child support agency can move quickly to seize income and assets of a delinquent noncustodial parent without first passing through a judicial or quasi-judicial hearing process."

A captive of Saddam Hussein during the first Gulf War In jail

Medically incapacitated

Lost their job but were confident of another so did nothing until it was too late

Did not know they could not ask for retroactive adjustments and waited too long.

Cannot afford a lawyer to seek adjustment when adjustment was warranted

Wouldn’t use the legal system even if they could, feeling it alien from their world, so don’t ask for a reduction when the legal establishment expects them to.

Some say this measure is a violation of due process and cruel and unusual as it removes the use of human discretion from dealing with individual cases, not to mention removing human compassion. But non-custodial fathers do not have the money to fight a constitutional case."

As of 2004[update], the Bradley Amendment was being challenged as unconstitutional and was the subject of a repeal effort.

February 2006 the court case has been dismissed and Congress has made no visible effort to reform the Bradley amendment.

Over two million people, or nearly one in 50 adults, excluding the elderly, are incarcerated, the highest proportion in the world. Some seven million Americans, or 3.2 percent, are under penal supervision.

Woman arrested in 1998 kidnapping of sons, children found safe

First thing this mother does to justify her actions of kidnapping is to claim domestic violence and that the father sexually molested the children....

During her arrest, the mother told the media that she was using an alias because she was a victim of domestic abuse. A LIE? She also told the two children over the years that their father had sexually molested them. A LIE?

Father was originally awarded full custody in 1998 and claims "accusations" against him have "no merit to her claims." and denied any wrong doing.

Yesterday, December 31, 2009 a Pennsylvania woman, Jill Haugen, was arrested 11 years after kidnapping her children, who are now aged 15 and 16. She was taken into custody after contacted police and told then that she didn't want to care for her children any longer. After the state of Pennsylvania took the boys into foster care, a caseworker discovered that Haugen was a fugitive and was wanted for felony kidnapping (and not just a mom wanting to relinquish her rights to her kids) back in Washington state.

According to the Spokane Police Department, Haugen had not won primary custody after she and Bill Conningham had divorced in 1998, and decided to flee with the boys during a scheduled visitation.

Feds Stop Child Support Collection Firm in Georgia

Company is illegally garnishing wages, suspending drivers licenses, and having parents arrested.

Mail and checks sent to the company's rented mailbox are being confiscated by the government. Not all parents know that yet, so they keep sending money.

What are we as non-custodial parents suppose to do to get our payments to the custodial parent when COURT ORDERED to pay child support through CHILD SUPPORT SERVICES???? This is quite ridiculous!

Parents whos checks are being confiscated may have to pay twice to stay out of jail!!!!! This is BS!!!!!!!!!!!

ATLANTA, Ga. (MyFOX Atlanta) - Federal investigators have stepped in to stop a Georgia child support collection agency from doing business, but this has left many parents confused about what they are now supposed to do.

Parents are confused because they have contracts and what they believe to be are court orders to pay Child Support Services. Chances are that the paper is actually worthless.

Child Support Services is a private company that is supposed to administer child support payments. A court document said the company often kept the money for "personal use" instead of sending it to parents.

Greedy introduced a bill today, S.O.B. 101, allowing for Genetic and DNA testing of all Americans to determine if they are the reincarnation of parents who still owe child support. The Senators claim in their bill that parents must learn to financially support their children, even after death.

The bill will allow Human Resource Departments in all fifty states to use the testing to determine reincarnation and to collect back child support for numerous cases that have been closed due to a deceased parent. It will also allow all fifty states to apply for additional Title IV-D funding.

Senator I.M. Greedy states that, "You would be amazed at all the reincarnated deadbeat parents walking among us that are not financially supporting their children." he goes on to say, "We will not let these parents go unpunished nor these children go without."

Senator Usta B. Straight made a public statement earlier today claiming, "All controversy aside, this bill is in the best interest of children."

Opponents of the bill, 99.9% of the general population, claim that S.O.B. 101 is nothing more butt "pork politics" out of Washington and will not benefit, but only harm families and children nationwide. Opponents of the bill were to march on Washington this week but were prevented from doing so because of heavy restrictions due to the city repairing a sidewalk.

Supporters of the bill called the opponents of the bill nothing but a bunch of "dead"beat parent lovers.

The bill also makes it mandatory for the Genetic and DNA testing and anyone that refuses will be incarcerated for life for contempt. The bill has a 1 strike policy claiming that according to the theory of reincarnation, their testing procedure is 99.99999% accurate. Opponents of the bill have demanded evidence of the testing procedure and process but were denied due to it being a national security issue.
